PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 10 February 1994, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with a general, under honorable conditions discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement in his own behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. On 14 March 1994, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an honorable discharge.

         b. On 18 March 1994, the applicant was discharged. At the time of discharge, the applicant had 3 years, 6 months, and 8 days, service on his current enlistment.

         c. The unit commander indicated that his specific reasons for initiating separation action were: failure to follow instructions; failure to return to your appointed place of duty at the appropriate time; substandard performance of duty; and, failing to pay a just debt in a timely manner.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (1) The issue is rejected. The Board carefully reviewed the applicant’s record of service during the period of enlistment under review . The Board noted that the applicant seeks a change in the narrative reason for his discharge to permit reenlistment. The evidence of record shows that the applicant was honorably discharged for unsatisfactory performance after a period of substandard performance, failure to follow instructions, and failure to pay his just debts. The Board determined that the applicant was properly discharged. The applicant provided no independent corroborating evidence demonstrating that either the command’s action was erroneous or that the appllicant’s service mitigated his misconduct or poor duty performance. Before initiating action to separate the applicant, the command ensured the applicant was appropriately counseled about the deficiencies that could lead to separation. The Board noted that the command made an assessment thereafter of the applicant's potential for becoming a fully satisfactory soldier, and the command appropriately determined the applicant did not demonstrate the potential for further military service. Further, the Board noted that the applicant was appropriately assigned an RE code of 3. An RE code of 3 indicates that the applicant requires a waiver prior to being allowed to reenlist. The applicant should see his local recruiter for assistance in this matter. The Board, being convinced that the reason for discharge was both proper and equitable, voted not to change it.
