PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 8 November 1994, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct, with a general, under honorable conditions discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, waived his rights and did not submit a statement on his behalf. The unit commander subsequently recommended separation with a general, under honorable conditions discharge. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a general, under honorable conditions discharge. The Staff Judge Advocate determined the separation action to be legally sufficient. On 30 November 1994, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a general discharge.

         b. On 19 December 1994, the applicant was discharged with a general, under honorable conditions discharge. At the time of discharge, the applicant had
1 year, 4 months, and 6 days service on his current enlistment and 3 years,
3 months and 9 days total time in service.

         c. The unit commander recommended separation action due to the applicant’s violation of Articles 91 and 92, UCMJ and his repeated violations of Article 134, UCMJ (failure to pay just debts).

 2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

          b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above:

 (1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The record does not support and the applicant has provided no evidence to support his contention that he was experiencing financial problems due to his not receiving basic assistance for quarters (BAQ) and separate rations. Even if true, the Board determined that the applicant had many legitimate avenues through which to obtain assistance or relief, without committing the misconduct which led to the separation action under review. The evidence of record shows that before initiating action to separate the applicant the command ensured the applicant was appropriately counseled about the deficiencies that could lead to separation and imposed nonjudicial punishment to assist him in performing and conducting himself to Army standards. The Board noted the command made an assessment of the applicant's potential for becoming a fully satisfactory soldier and that the applicant was afforded a reasonable opportunity to overcome noted deficiencies. As the applicant did not subsequently conform to required standards of discipline and performance, the command appropriately determined the applicant did not demonstrate the potential for further military service. The Board found no evidence of arbitrary or capricious actions by the command. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
