PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—patterns of misconduct, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, voluntarily waive his right to an administrative separation board contingent on receiving a GD, and submitted a statement in his own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. The separation authority approved the separation action and directed that the applicant be discharged with a GD.

         b. On 25 August 1997, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 3 years, 5 months, and 8 days of active military service.

         c. The applicant’s record shows that he completed almost 3 and ½ years of service; attained the rank of specialist/E-4; serve in combat during Operation Desert Storm; and earned an Army Achievement Medal, and the Southwest Asia Service Medal/with 1 bronze service star. His disciplinary record includes his acceptance of three Article 15’s: the first on 3 September 1996, for two specifications of failure to go to his prescribed place of duty (FTG), his punishment included a suspended reduction to private first class/E-3 which was vacated on 17 September 1996, for another incident of FTG; the second on
1 October 1996, for willfully disobeying a lawful order and for being disrespectful in language which resulted in a reduction to Private/E-2; and the third on 2 April 1997, for being disrespectful in language which resulted in a reduction to private/E-1. His unit commander processed him for separation for a pattern of misconduct, citing the applicant’s continued misconduct as the basis for taking the action.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.
