PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 31 December 1990, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 5, paragraph 8 AR 635-200, by reason of inability to perform prescribed duties due to parenthood, with a general discharge. She was advised of her rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, declined a separation medical examination and did not submit a statement in her own behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a general, under honorable conditions discharge. On 10 January 1991, the separation authority directed that the applicant be discharged with a general, under honorable conditions discharge.

         b. On 17 January 1991, the applicant was discharged. At the time of discharge, the applicant had 1 year, 5 months, and 29 days service on her current period of enlistment under review.

         c. The unit commander indicated that his specific reasons for initiating separation action were: refusal to complete a dependent care plan and subsequent nondeployability in accordance with the needs of the Army.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 5 paragraph 8 establishes policy and prescribes procedures for separating members for the inability to perform prescribed duties due to parenthood. “Army policy states that the service of personnel separated under this regulation is normally under honorable conditions is considered appropriate, or an uncharacterized description of service if in an entry level status, but an honorable discharge may be granted.”

2. Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(2) The issue is accepted. The Board carefully reviewed the applicant’s record of service during the period of enlistment under review. The evidence of record shows that the applicant was counseled for failing to complete a satisfactory child care plan and was subsequently discharged under the parenthood provisions of Chapter 5, AR 635-200. The Board noted that the record is void of nonjudicial punishments and court-martial proceedings. In view of the foregoing, the Board determined that the characterization of service was inequitable. Accordingly, the Board voted to grant the full relief in the form of an upgrade of characterization of service to fully honorable.

(3) The issue is accepted. Regulations currently in effect list the reason for the applicant’s discharge as parenthood. Accordingly, the Board voted to change the narrative reason on the DD Form 214 to parenthood.
