                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 20 August 2002, DA, HQ, 101st
Airborne Division (Air Assault) and Fort Campbell, Fort Campbell, KY,
Orders 232-0017 released the applicant from active duty and transferred her
to the Individual Ready Reserve, effective 26 August 2002.  The record
contains a properly constituted DD Form 214 (Certificate of Release or
Discharge from Active Duty) which was authenticated by the applicant.  Her
DD Form 214 indicates that she was discharged under the provisions of
Chapter 5-8, AR 635-200 by reason of parenthood, with a characterization of
service of honorable.  The specific facts and circumstances pertaining to
the applicant’s discharge are not contained in the available records.

      b.  On 26 August 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 2 months and 22 days of active
military service in the period under review and had a total of 4 years, 10
months and
26 days of total military service.

      c.  The evidence of record shows that the applicant had a prior
period of active duty from 30 September 1997 – 3 February 2001.  On 3
February 2002, she was released from active duty and transferred to the
Individual Ready Reserve with an honorable discharge.  On 30 March 2002,
she requested enlistment into the Regular Army.  On 15 May 2002, the
applicants RE code waiver request for pregnancy and asthma were approved.
On 5 June 2002, she enlisted in the Regular Army, and was released from
active duty after 2 months and 22 days service due to parenthood (current
enlistment being reviewed.)

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
provides the basic authority for the separation of enlisted personnel.
Paragraph 5-8 provides that a soldier may be separated when parental
obligations interfere with fulfillment of military responsibilities.
Specific reasons for separation because of parenthood include inability to
perform prescribed duties satisfactorily, repeated absenteeism, late for
work, inability to participate in field training exercises or perform
special duties such as CQ and Staff Duty NCO, and nonavailability for
worldwide assignment or deployment according to the needs of the Army.
Unless reason for separation requires a specific characterization, a
soldier being separated for the convenience of the government will be
awarded a character of service of honorable, under honorable conditions or
an uncharacterized description of service if in entry-level status.

      a.  Propriety:   The parenthetical number(s) below correspond(s) to
                   the issue number(s) on the DD Form 293, or in Part VI,
                   Paragraph 1, above.

        (1)  The issue is rejected.  The applicant’s record is void of
facts and circumstances concerning events that led to a discharge from the
Army.  The Board noted that the applicant’s record contains a properly
constituted DD Form 214 (Certificate of Release or Discharge from Active
Duty) which was authenticated by the applicant.  This document identifies
the reason and characterization of the discharge and the Board presumed
government regularity in the discharge process.  Individuals are assigned
RE codes based on their service records or the reason for separation.  The
applicant was appropriately assigned an RE code of 3 because she was
separated under the provisions of AR 635-200, Chapter 5-8, by reason of
parenthood.  An RE Code of 3 indicates that the applicant requires a waiver
prior to being allowed to reenlist.  This Board is not empowered to change
RE codes.  If the applicant desires to reenlist, she should contact a local
recruiter to determine her eligibility to reenlist.  Those individuals can
best advise a former service member as to the needs of the military
services at the time, and are required to process waivers of RE codes.  The
Board, being convinced that the reason for discharge and the
characterization of service were both proper and equitable, voted to deny
relief.

      b.  Equity:      The applicant has not submitted an issue of equity
                   and the ADRB has not otherwise relied upon an issue of
                   equity to change the discharge.  The major factors upon
                   which the discharge was based are set forth in Parts III
                   and IV of this decisional document.
