PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 11 March 1994, the appropriate authority notified the applicant of initiation of separation action under the provisions of Chapter 4, AR 635-120 by reason of acts of personal misconduct and conduct unbecoming an officer. On 20 May 1994, the applicant voluntarily tendered his resignation from the Army under the provisions of Chapter 4, AR 635-120 in lieu of elimination proceedings. He was advised of the impact of his voluntary request for resignation, waived his rights to consult with legal counsel and did not submit a statement in his own behalf. The appropriate authorities recommended approval of the applicant’s resignation with issuance of an honorable discharge. On 19 October 1994, the appropriate authority, directed that the applicant’s resignation in lieu of elimination be accepted with an honorable discharge.

         b. On 4 November 1994, the applicant was discharged. He was credited with
5 years and 13 days of active military service.

         c. The applicant’s submitted his resignation because he was being considered for administrative elimination due to acts of personal misconduct and conduct unbecoming an officer. That misconduct included falsifying his scores on an Army Physical Fitness Test Scorecard and forging another officer’s signature on the scorecard.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-120 sets for the basic authority for Officer transfers and discharges. Chapter 4 outlines the policy and procedure for the eliminating officer from the active Army for substandard performance of duty, misconduct, moral or professional dereliction, and the interest of national security.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above:

(1) The issue is rejected. The Board carefully reviewed the applicant’s record of service. There was a full consideration of all faithful and honorable service as well as the infraction of discipline, the extent thereof, and the seriousness of the offense. The Board concluded that even though the applicant’s misconduct was an isolated incident it constituted a departure from the standards of conduct expected of officers in the Army. The Board found no evidence of arbitrary or capricious actions by the command. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. Additionally, the Board does not grant relief solely for the purpose of gaining employment or enhancing employment opportunities. The Board, being convinced that the reason for discharge was both proper and equitable, voted to deny relief.
