8.       Remarks: It was discovered during the review of this case that there may be an error of omission in the awards listed on the DD Form 214 (Certificate of Release or Discharge from Active Duty) issued the applicant at discharge. The applicant provided an Army Commendation Medal Certificate to this Board which is not listed on his DD Form 214. However, the Army Discharge Review Board (ADRB) is not empowered to correct this portion of military records. The ADRB may only change the characterization or reason for discharge. If the applicant wishes to address this issue he should make application to the Army Board for Correction of Military Records utilizing the enclosed DD Form l49.

PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 25 April 1996, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 13 May 1996, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 20 May 1996, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 2 years, 9 months, and 11 days of active military service.

         c. The applicant’s record shows that he completed almost 3 years of service; attained the rank of private first class/E-3; completed an overseas tour in Korea; that he earned two Army Achievement Medals, and while not in the available records, it appears an Army Commendation Medal. His disciplinary record includes his acceptance of three Article 15’s: the first on 12 April 1995, summarized, for consuming alcoholic beverages under the age of 21; the second on 3 May 1995, for failing to go to his prescribed place of duty which resulted in a reduction in rank to private/E-2; and the third on 7 June 1995, for failing to go to his prescribed place of duty which resulted in his reduction to private/E-1. The record also shows that the applicant was barred from reenlistment on 19 July 1995 based on his disciplinary record. The unit commander processed the applicant for separation for a pattern of misconduct based on the incidents outlined above.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1) and (2) The issues are rejected. The Board noted the applicant’s contentions that, in effect, his discharge was inequitable because of the time it took to process the action; and that his overall record of service and his awards and decorations were not taken into account at the time of his discharge. However, after carefully examining the applicant’s record of service for the period of enlistment under review, the Board found that the applicant's discharge was appropriate. Further, the Board determined that the quality of the applicant’s service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that his service mitigated his misconduct sufficiently to warrant relief. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
