PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The specific facts and circumstances surrounding the applicant’s discharge are not contained in the available records. However, the record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), authenticated by the applicant, which documents the following facts: Character of Service-General, Under Honorable Conditions (GD); Authority for Separation-Chapter 13, AR 635-200; and Narrative Reason for Discharge-Unsatisfactory Performance.

         b. The DD Form 214 also verifies that the applicant was separated on
23 November 1998, with a GD. At the time of discharge, the applicant had completed 1 year, 7 months, and 26 days of active military service.

         c. The available records show that the applicant completed just over 1 and ½ years of service and attained the rank of specialist/E-4. 2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.
