PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The specific facts and circumstances surrounding the events which led to the applicant’s discharge are not contained in the available records. However, the evidence of record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), authenticated by the applicant, which documents the following facts: Character of Service-General, Under Honorable Conditions (GD); Authority for Separation-Chapter 13, AR 635-200; and the Narrative Reason for Separation-Unsatisfactory Performance.

         b. The DD Form 214 also shows that the applicant was discharged on 25 April 1998, with a GD after completing 1 year, 2 months, and 21 days of active military service.

         c. The applicant’s record shows that he completed just over a year of service and the highest rank he attained while on active duty was private first class/E-3. There are no documented acts of valor, significant achievement, or service warranting special recognition contained in the available records. The is also no disciplinary history available for review. The applicant was contacted and advised that the available records did not contain information on the specific events which led to his discharge and was given time to provide any additional records or documentation for the Board’s the review. However, there have been no additional records provided by the applicant for the Board’s review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

 (1) The issue is rejected. The Board noted the applicant’s contention that, in effect, his discharge was improper because he was a good soldier, that he never drank, that he always did what he was told, and that he was always on time for formations which can be verified from his records. The available records do not contain the specific facts and circumstances concerning the events which led to the applicant’s discharge from the Army. However, the evidence of record does include a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. This document identifies the reason and characterization of the discharge and the Board presumed government regularity in the discharge process. The Board, being convinced that the reason for discharge and the characterization of service were proper and equitable, voted to deny relief.
