PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 15 May 1995, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with an honorable discharge (HD). She was advised of her rights. The applicant acknowledged notification, consulted with legal counsel, was advised of the impact of the discharge action, and voluntarily waived consideration of her case by an administrative separation board contingent upon her receiving a characterization of service no less favorable than an honorable discharge, and submitted a statement in her behalf. The unit commander subsequently recommended separation with an HD. On 15 June 1995, the separation authority directed that the applicant be discharged with an HD.

         b. On 29 June 1995, the applicant was discharged with an honorable discharge, under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance. At the time of discharge, the applicant had 2 years,
3 months, and 5 days on her current enlistment and 6 years, 4 months and 2 days total time in service.

         c. The unit commander indicated that his specific reasons for initiating the applicant’s discharge was the following: failure to obtain a passing score on three consecutive APFT’s administered on 5 May 1994, 8 August 1994, and 3 May 1995.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(5) The issue is accepted. The Board carefully reviewed the applicant’s record of service during the period of enlistment under review.
The evidence of record supports that medical problems impaired the applicant’s ability to serve. The Board also noted that the applicant’s overall performance of duty was excellent resulting in the award of the Joint Service Achievement Medal and the Army Achievement Medal. In view of the foregoing, the Board determined that the narrative reason for separation was inequitable. Accordingly, the Board voted to change the reason for separation to secretarial authority.

(1) The issue is rejected. Notwithstanding the fact that the applicant was directed to apply to the Army Discharge Review Board to exhaust her administrative remedies, requests for medical disability separations from the Army fall within the purview of the Army Board for Correction of Military Records (ABCMR). The Board noted that the applicant has provided a DD Form 149 (application to the ABCMR) and this Board will forward said application to the ABCMR.
