PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 20 April 1993, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 26 April 1993, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 6 May 1993, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 1 year, 8 months, and 16 days of active military service, and had accrued 24 days of time lost due to AWOL.

         c. The applicant’s record shows that he completed a 1ittle over 1 year and
8 months of service; that he attained the rank of specilist/E-4; and that he earned an Army Achievement Medal. His disciplinary record includes his acceptance of two Article 15’s: the first on 22 October 1992, for two separated periods of AWOL totaling 24 days, his punishment included a reduction in rank to private/E-1; and the second on 1 March 1993, for dereliction of duty as a paratrooper by failing to don his parachute. His unit commander processed the applicant for discharge for displaying a pattern of misconduct, citing the disciplinary record outlined above, and an extensive record of counseling for misconduct and poor duty performance, as the basis for taking the action.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.


         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.


3. Response to items not addressed as decisional issues:

The Board noted the applicant’s contentions, outlined in his enclosed statement to the Board, that, in effect, his service was good and his misconduct was an inappropriate response to personal problems he was experiencing at the time; and that he has become an ordained minister and has straightened out his life and desires a second chance. However, after carefully examining the applicant’s record of service for the period of enlistment under review, the Board concluded that applicant’s discharge was appropriate, and that his misconduct clearly diminished the quality of his service below that meriting a fully honorable discharge. The evidence of record shows that the command attempted to assist the applicant in performing and conducting himself to Army standards, and the applicant had many legitimate avenues through which to obtain assistance or relief, without committing the misconduct which led to the separation action under review. Further, while the Army Discharge Review Board acknowledges the applicant's successful transition to civilian life and noted the many accomplishments outlined in his statement enclosed with his application; the Board found that these accomplishments did not overcome the reason for discharge and characterization of service granted.
