PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 8 March 1996, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, waived legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The unit commander subsequently recommended waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 8 March 1996, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 15 March 1996, the applicant was discharged with a general, under honorable conditions discharge. At the time of discharge, the applicant had completed 1 year, and 15 days of his current enlistment, 4 years 11 months,
3 days of active military service, and a total of 7 years, 4 months, and 19 days of credible service.

         c. The applicant’s record shows that he completed almost 5 years of active duty and over 7 years of military service; the highest rank he attained on active duty was specialist/E-4; he completed an overseas tour in Germany, he had
5 months of combat service during Operation Desert Storm; and he earned an Army Achievement Medal, a Good Conduct Medal, the Southwest Asia Service Medal, and the Kuwait and Saudi Arabia Liberation Medal. The applicant’s disciplinary record includes his acceptance of a field grade Article for making a fake official statement and wrongfully utter checks with insufficient funds which resulted in a reduction in rank to private/E-1. The unit commander processed the applicant for separation citing the offenses outlined above, for trying to clear post while pending UCMJ, and for being AWOL for two days.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

 (1) The issue is rejected. The Board noted the applicant’s contention that, in effect, he is sincerely sorry for his actions which resulted in his discharge but would now like a chance to improve his future. After carefully examining the applicant’s record of service for the period of enlistment under review, the Board concluded that this factor does not provide a sufficient basis on which to grant relief. The applicant's discharge was appropriate because the quality of his service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that his service mitigated the misconduct. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
