PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 7 March 1992, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—serious misconduct, with a recommendation for an under other than honorable conditions (UOHC) discharge. The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, voluntarily waive consideration of his case by an administrative separation board contingent on receiving a general, under honorable conditions discharge (GD), and elected not to submit a statement in his own behalf. The intermediate commanders reviewed the proposed discharge action and recommended approval of the separation action with a GD. The Staff Judge Advocate recommended approval the applicant’s request for conditional waiver. On 3 September 1992, the separation authority approved the applicant’s conditional waiver and directed that the applicant be discharged with a GD.

         b. On 14 September 1992, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 1 year, 4 months, and 8 days of his current enlistment, and a total of 8 years, 9 months and 2 days of active military service.

         c. The applicant’s record shows that he completed almost 9 years of service; attained the rank of sergeant/E-5; completed an overseas tour in Korea; and earned an Army Commendation Medal, Army Achievement Medal, and a Good Conduct Medal. His disciplinary record for the period of service under review, includes his acceptance of an Article 15 on 5 November 1991, for being AWOL from 19 to 22 August 1991. His punishment for this offense included a suspended reduction to specialist/E-4 which was vacated on 3 January 1992, based on an incident of AWOL from 27 to 31 December 1991. The unit commander processed the applicant for separation based on a pattern of misconduct, citing a positive drug test, the three periods of AWOL outlined above, and two incidents of failure to report as the basis for taking the action. The applicant completed a conditional waiver of his right to an administrative separation board, contingent on receiving a GD which was ultimately approved.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.
