PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 1 March 1994, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—commission of a serious offense, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 8 March 1994, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 23 March 1994, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 1 year, 7 months, and 12 days of active military service.

         c. The applicant’s record shows that he completed just over 1 and ½ years of service and the highest rank he attained while on active duty was private/E-2. There are no documented acts of valor, significant achievement, or service warranting special recognition contained in the record. His disciplinary record includes his acceptance of three Article 15’s: the first on 27 January 1973, summarized, for failure to follow instructions and failure to prepare; the second on 18 June 1993, for being derelict in his duties which included a reduction to private/E-1; and the third on 30 September 1993, summarized, for failure to obey a lawful order. On 27 October 1993, a bar to reenlistment was imposed on the applicant based on the disciplinary record outlined above. The unit commander processed the applicant for separation based on the commission of a serious offense, citing the applicant’s disciplinary history as outlined above and the extensive record of counseling contained in the record, as the basis for taking the action. In addition, although not contained in the available records, the unit commander cited the applicant’s conviction by summary court-martial for unauthorized absences, in support of the separation action.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

(1) and (2) The issues are rejected. The Board noted the contentions of the applicant, as outlined in his statement enclosed with his application, that, in effect, he was young and immature at the time of his discharge and did not fully understand the ramifications of his discharge; and that he is currently in the criminal justice field and would like to stay in and advance in this field but is limited because of his discharge. However, the Board concluded that these issues do not mitigate the applicant’s misconduct sufficiently to warrant relief. The Board carefully examined the applicant's record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board concluded that the discrediting entries in the applicant's record were not outweighed by prior or subsequent service of sufficient merit to warrant an upgrade of the discharge being reviewed. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
