PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 9 December 1993, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The unit commander subsequently recommended separation with a GD. The separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 9 February 1994, the applicant was discharged with a GD. At the time of his discharge the applicant had completed 3 years, 9 months, and 2 days of active military service.

         c. The applicant’s record shows that he completed 3 years and 9 months of his 4 year enlistment; the highest rank he attained while on active duty was specialist/E-4; that he completed an overseas tour in Germany; and that he earned an Army Achievement Medal and a Good Conduct Medal. The applicant’s disciplinary record includes his acceptance of four Article 15’s: the first on 5 February 1993, summarized, for two incidents of missing formations; the second on
24 February 1993, summarized, for failing to follow the commander’s order and for showing disrespect toward all NCO’s; the third on 30 March 1993, for failing to go to his prescribed place of duty which resulted in a suspended reduction to private first class/E-3; and the fourth on 24 August 1993, for failing to go to his prescribed place of duty which resulted in a suspended reduction to private/E-2 which was vacated on 1 September 1993. On 22 June 1993 a bar to reenlistment was imposed on the applicant based on the disciplinary record outlined above. The unit commander processed the applicant for separation based on a pattern of misconduct and cited the applicant’s failure to response to counseling for eight incidents of failure to repair and his overall disciplinary record as the basis for the action.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.
