PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 16 June 1995, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—commission of a serious offense, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, waived a hearing by a board of officers, and elected not to submit a statement in his own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 13 July 1995, the separation authority directed that the applicant be discharged with a GD.

         b. On 4 October 1995, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 2 years, 11 months, and 20 days of active military service.

         c. The applicant’s record reflects that he completed almost three (3) years of service, and the highest rank he attained while on active duty was private first class/E-3. There are no documented acts of valor, significant achievement, or service warranting special recognition. However, there is an extensive disciplinary history which includes his acceptance of four (4) Article 15’s: the first on 23 June 1993, summarized, for failing to pay a just debt; the second on 9 July 1993, summarized, for being absent without authority; the third on 7 February 1994, summarized, for being derelict in responsibility; and the fourth on 7 April 1995, for failure to go to his prescribed place of duty and for failing to pay a just debt which resulted in his reduction to private/E-2. The record also contains several counseling statements for a myriad of minor infractions and a bar to reenlistment certificate, which was imposed on 28 March 1995 for financial mismanagement, disobeying a lawful order, and for being absent without authority; in addition, the unit commander used the applicant’s entire disciplinary record as support for imposing the bar action. The unit commander cited a significant portion of the applicant’s disciplinary history, outlined above, as the basis for processing him for separation.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

 (1) The issue is rejected. The Board noted the applicant’s contention that, in effect, he was wrongly treated because he was a witness to a murder. However, after carefully examining the applicant’s record of service for the enlistment under review, the Board found no evidence of arbitrary or capricious actions by the command. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
