PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 9 April 1990, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—commission of a serious offense, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, completed a conditional waiver of his right to an administrative separation board contingent on receiving a GD, and elected not to submit a statement in his own behalf. The intermediate level commanders reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 8 May 1990, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 29 May 1990, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 3 years, 9 months, and 12 days of his current enlistment, and a total of 7 years, 6 months and 14 days of active military service.

         c. The applicant’s record shows that he completed over 7 years of service; attained the rank of specialist/E-4; completed overseas tours in Korea and Honduras; and earned the Armed Forces Expeditionary Medal, the Army Achievement Medal, and two Good Conduct Medals. His disciplinary record, for the period of service under review, includes his acceptance of two Article 15’s: the first on 28 November 1988, for wrongfully using cocaine which included a reduction in rank to private first class/E-3; and the second on 23 March 1990, for the wrongful use of cocaine which included a reduction to private/E-2. The unit commander processed the applicant for separation based on the commission of a serious offense based on the drug incidents outlined above. The applicant completed a conditional waiver of his right to an administrative separation board, contingent on receiving a GD, and was discharged accordingly.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(7) The issue is accepted. Regulations currently in effect list the reason for the applicant’s discharge as misconduct. Accordingly, the Board voted to change the narrative reason on the DD Form 214 to misconduct. The Board was satisfied that the characterization of service was proper and equitable, and voted not to change it.

(1), (2), (3), (4), (5), and (6) The issues are rejected. The Board noted the applicant’s contentions that, in effect, that his discharge should be upgraded because he received awards and decorations; received letters of recommendation; had combat service; had prior honorable service; has been a good citizen since his discharge; and that he has enlisted in the Army National Guard. However, after carefully examining the applicant’s record of service for the period of enlistment under review, the Board concluded that the applicant’s discharge was appropriate, and accomplished under the terms of his own conditional waiver. The applicant, by violating the Army's policy not to possess or use illegal drugs, compromised the trust and confidence placed in him as a soldier. As a soldier, he had the duty to support and abide by the Army's drug policies. By abusing illegal drugs, the applicant knowingly risked a military career and diminished the quality of his service below that meriting a fully honorable discharge.
