PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 20 February 1990, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—abuse of illegal drugs, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, waived his right to have his case heard by an administrative separation board, and elected not to submit a statement in his own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 28 February 1990, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 7 March 1990, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 1 year, 7 months, and 23 days of his current enlistment, and a total of 6 years, 7 months and 19 days of active military service.

         c. The applicant’s record reflects that he had completed over 6 and ½ years of service; attained the rank of sergeant/E-5; and had earned two Good Conduct Medals and two Army Achievement Medals. There is no record of derogatory information prior to the incident which led to his discharge. The applicant tested positive for cocaine on a unit urinalysis, and on 14 February 1990 he accepted an Article 15 for the wrongful use of cocaine which resulted in his reduction in rank to specialist/E-4. The applicant’s unit commander processed him for separation by reason of commission of a serious offense based on this incident of cocaine use. The applicant waived his right to have his case heard by an administrative separation board and elected not to submit a statement in rebuttal of the separation action.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1) The issue is rejected. The Board noted the applicant’s contention, as outlined in his statement and presentation to the Board, that his addiction to drugs impaired his ability to serve; but that since his separation from service he has received treatment and has remained drug free. The applicant is to be commended for these efforts. However, these accomplishments do not provide the Board a basis upon which to grant relief. The Board concluded that the applicant, by violating the Army's policy not to possess or use illegal drugs, compromised the special trust and confidence placed in him as a non-commissioned officer (NCO). As an NCO, he had the duty to support and abide by the Army's drug policies. By abusing illegal drugs, the applicant knowingly risked a military career and this misconduct diminished the quality of his service below that meriting a fully honorable discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
