PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 30 December 1991, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635 200, by reason of unsatisfactory performance, with a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The unit commander subsequently recommended separation with a GD. On 1 January 1992, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 10 January 1992, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 1 year, 11 months, and 18 days of active military service.

         c. The applicant’s record reflects that he completed almost 2 years of his 3 year enlistment and that the highest rank he held on active duty was private first class/E-3. There are no documented acts of valor, significant achievement, or service warranting special recognition contained in the record. However, there is a recorded history of performance and conduct related infractions. On 19 December 1991 the applicant accepted an Article 15 for being disrespectful to a superior commissioned officer which resulted in his reduction in rank to private/E-1. The record also contains several formal counseling statements issued to the applicant for numerous performance and conduct related disciplinary infractions. The applicant’s unit commander processed the applicant for separation for unsatisfactory performance, citing the applicant’s substandard duty performance and the fact that his conduct was prejudicial to good order and discipline, as the basis for taking action.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (1) The issue is rejected. The Board noted the applicant’s contention that, in effect, his ability to serve was impaired because he was under a great deal of stress related to personal problems at the time of his discharge. However, the Board found this factor was not sufficiently mitigating to warrant an upgrade of his discharge. After carefully examining the applicant’s record of service for the enlistment under review, the Board concluded that the applicant's discharge was appropriate because the quality of his service was not consistent with the Army's standards for acceptable personal conduct and performance of duty. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that his service mitigated the misconduct or poor duty performance. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
