PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The specific facts and circumstances surrounding the events which led to the applicant’s discharge are not contained in the available records. However, the record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), authenticated by the applicant, which documents the following facts: Authority for Separation: Paragraph 14-12b, AR 635-200; Narrative Reason for Separation-Misconduct; and Character of Service-General, Under Honorable Conditions (GD).

         b. The DD Form 214 also shows that on 23 September 1997, the applicant was separated with a general, under honorable conditions discharge (GD), after completing 3 years, 11 months, and 11 days of active military service.

         c. The available records show that the applicant was discharged for misconduct 19 days short of completing his 4 year enlistment, and that he had earned an Army Achievement Medal, the Good Conduct Medal, and the Overseas Service Ribbon. These records do not contain the applicant’s disciplinary history; however, by his own admission he received two Article 15’s: the first for leaving an unsecured vehicle and the second for breaking restriction; and a court-martial for missing extra duty which resulted in his being sentenced to
15 days of confinement. In his statement to the Board, the applicant also indicated that he had attained the rank of private first class/E-3 while on active duty, but at the time of his discharge his rank was listed as private/E-1. The applicant also refers to receiving three Army Achievement Medals, while only one is accounted for on his DD Form 214; in addition, he claims that he received a Humanitarian Service Medal which is also not documented on the DD Form 214. The available records are limited and consist of only the DD Form 214 issued the applicant at the time of his discharge and a service microfiche with limited information.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

(1) The issue is rejected. The Board noted the applicant’s contention that, in effect, his discharge was inequitable for the reasons he outlined in his statement to the Board which accompanied his application. The available records do not contain the specific facts and circumstances concerning the events that led to the applicant’s discharge from the Army. However, the Board noted that the applicant’s record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. This document identifies the reason and characterization of the discharge and the Board presumed government regularity in the discharge process. The Board, being convinced that the reason for discharge and the characterization of service were proper and equitable, voted to deny relief.
