PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 27 July 1993, DA, HQ, I Corps, Ft Lewis, Washington, Orders 119-4 discharged the applicant from the Regular Army, effective date 30 July 1993. The record contains a properly constituted DD Form 257 (Certificate of Release or Discharge from Active Duty) indicating the applicant received a general, under honorable conditions discharge. (GD). The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records.

         b. On 30 July 1993, the applicant was discharged. At the time of discharge, the applicant had completed NIF years, NIF months, and NIF days of active military service in the period under review.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 10 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for discharge for the good of the service in lieu of trial by court-martial. The request may be submitted at any time after charges have been preferred and must include the individual's admission of guilt. Army policy states that although an honorable or general discharge is authorized, a discharge under other than honorable conditions is normally considered appropriate.
