PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 28 February 1997, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 5, AR 635-200 and personality disorder, with a recommendation for an honorable discharge (HD). The applicant was advised of her rights,consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement in her own behalf. The intermediate level commander reviewed the proposed discharge action and recommended approval. On 25 March 1997, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an HD.

         b. On 14 April 1997, the applicant was discharged with an HD. At the time of discharge the applicant had completed 1 year, 9 months, 19 days of her current enlistment, and a total of 5 years, 2 months and 17 days of active military service.

         c. The applicant’ s record shows that she completed over 5 years of service; attained the rank of sepcialist/E-4; and that she earned the Good Conduct Medal, the Armed Forces Service Medal, and the NATO Medal for service in Bosnia. On 12 February 1997, the applicant underwent a psychiatric evaluation which resulted in a diagnosis of personality disorder and a recommendation that the applicant be separated, under the provisions of Paragraph 5-13, AR 635-200. On 13 March 1997 the unit commander initiated separation action based on the personality disorder diagnosis and the applicant’s recent suicide attempt. The applicant was afforded all rights associated with the action and was discharged accordingly.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-13 provides that a soldier may be separated for personality disorder, not amounting to disability under Army Regulation 635-40, that interferes with assignment to or performance of duty. The regulation requires that the condition is a deeply ingrained maladaptive pattern of behavior of long duration that interferes with the soldiers ability to perform duty. The regulation also directs that commanders will not take action prescribed in this chapter in lieu of disciplinary action, requires that the diagnosis concludes the disorder is so severe that the soldier’s ability to function in the military environment is significantly impaired, and states that separation for personality disorder is not appropriate when separation is warranted under chapter 4, 5, 7, 9, 10, 11, 13, 14, or 15; Army regulation 604-10 or Army Regulation 635-40. Army policy requires the award of a fully honorable discharge in such cases.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.


         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1), (2), (3), and (4) The issues are rejected. The Board noted the applicant’s contentions that, in effect, she had one problem in five years of service; that she does not think she was treated fairly; that she wishes that the reason for her discharge and the reentry eligibility (RE) code be changed in order that she be eligible to reenter service; and that she would like her entire service considered, not just her one problem. After carefully examining the applicant’s record of service for the period of enlistment under review, the Board concluded that the applicant was properly discharged for a personality disorder under the provisions of Chapter 5, AR 635-200, as diagnosed by competent medical authority. The quality of the applicant’s service was appropriately recognized with the award of an honorable characterization of service. The Army Discharge Review Board cannot change the applicant’s reentry eligibility (RE) code. If the applicant desires to reenlist, she should contact the local recruiter to determine her eligibility to reenlist. Those individuals can best advise a former service member as to the needs of the Army at the time, and are required to process waivers of reentry eligibility (RE) codes. The Board, being convinced that the reason for discharge was both proper and equitable, voted not to change it.
