PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 14 November 1997, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 5, AR 635-200 and reason of personality disorder, with an honorable discharge (HD). She was advised of her rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement on her behalf. The unit commander subsequently recommended approval separation with an HD and forwarded it through command channels to the separation authority. The intermediate commander reviewed the proposed discharge action and recommended approval with an HD. On 13 January 1998, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an HD.

         b. On 28 January 1998, the applicant was discharged with an honorable discharge, under the provisions of Chapter 5, AR 635-200, by reason of personal disorder. She was credited with 1 year, 5 months, and 2 days active service on the enlistment under review.

         c. The unit commander indicated that his specific reasons for initiating the applicant’s discharge were the following: the applicant’s suicide gesture by attempting to drink a bottle of Windex; and her being diagnosed by competent medical authority with a personality disorder.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-13 provides that a soldier may be separated for personality disorder, not amounting to disability under Army Regulation 635-40, that interferes with assignment to or performance of duty. The regulation requires that the condition is a deeply ingrained maladaptive pattern of behavior of long duration that interferes with the soldiers ability to perform duty. The regulation also directs that commanders will not take action prescribed in this chapter in lieu of disciplinary action, requires that the diagnosis concludes the disorder is so severe that the soldier’s ability to function in the military environment is significantly impaired, and states that separation for personality disorder is not appropriate when separation is warranted under chapter 4, 5, 7, 9, 10, 11, 13, 14, or 15; Army regulation 604-10 or Army Regulation 635-40. Army policy requires the award of a fully honorable discharge in such cases.

(1) and (2) The issues are rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The specific documents referred to in the applicant’s issues were not available for the Board’s review and the applicant has not provided them. However, sufficient separation records were available to the Board to show that the applicant was diagnosed with a Personality Disorder by competent medical authority prior to being processed for separation. Absent evidence to the contrary, the Board presumed administrative regularity in the discharge process. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable voted to deny relief.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(3), (4), and (5) The issues are rejected. The Board noted the applicant’s contentions that her service and qualifications were to standard. However, based on the available evidence of record, the applicant was counseled for suicide gestures, inability to control emotions or to accept professional criticism, failure to maintain accountability of her protective mask, military appearance, and her initiative on the job.

(6) The issue is rejected. The Board found no evidence of arbitrary or capricious actions by the command. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process.

(7) The issue is rejected. Before initiating action to separate the applicant, the command ensured the applicant was appropriately counseled about the deficiencies which could lead to separation. The Board noted the command made an assessment of the applicant's potential for becoming a fully satisfactory soldier. The evidence of record established that the applicant was diagnosed with a personality disorder and not recommended for further military service.
