PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 9 January 1996, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 5, AR 635-200, personality disorder, with an honorable (HD) discharge. The applicant was advised of her rights, declined legal counsel, was advised of the impact of the discharge action, and submitted a statement in her own behalf. On 24 January 1996, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an HD.

         b. On 1 February 1996, the applicant was discharged with an HD. At the time of her discharge the applicant had completed 4 years, 10 months, and 11 days of active military service.

         c. The applicant’s record shows that she completed almost 5 years of service; attained the rank of specialist/E-4; completed an overseas tour in Korea; and that she earned the Army Achievement Medal and Good Conduct Medal. The applicant underwent extensive mental evaluation and was diagnosed with a personality disorder by competent medical authority. Although the applicant received a conflicting diagnosis from a clinical psychologist, this did not sway the psychiatric opinion rendered. The applicant was seen on several occasions and the original personality disorder diagnosis remained in tact. The applicant was processed for separation for a personality disorder and afforded all rights associated with the action. The evidence of record does not reflect any inappropriate actions on the part of the chain of command.

 2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-13 provides that a soldier may be separated for personality disorder, not amounting to disability under Army Regulation 635-40, that interferes with assignment to or performance of duty. The regulation requires that the condition is a deeply ingrained maladaptive pattern of behavior of long duration that interferes with the soldiers ability to perform duty. The regulation also directs that commanders will not take action prescribed in this chapter in lieu of disciplinary action, requires that the diagnosis concludes the disorder is so severe that the soldier’s ability to function in the military environment is significantly impaired, and states that separation for personality disorder is not appropriate when separation is warranted under chapter 4, 5, 7, 9, 10, 11, 13, 14, or 15; Army regulation 604-10 or Army Regulation 635-40. Army policy requires the award of a fully honorable discharge in such cases.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (1) The issue is rejected. The Board noted the applicant’s contention that, in effect, she would like the narrative reason for her discharge changed from personality disorder and have all rights and privileges restored. Restoring privileges in not within the purview of the Army Discharge Review Board (ADRB). After carefully examining the applicant’s record of service for the period of enlistment under review, the Board concluded that the narrative reason for discharge was appropriate. The applicant was diagnosed by competent medical authority on 6 November 1995 as having a personality disorder, and separation was recommended under the provisions of Paragraph 5-13, AR 635-200. The applicant provided no independent corroborating evidence demonstrating that the personality disorder diagnosis was incorrect at the time or that the command's action was erroneous. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
