SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The evidence of record shows that on 14 April 1997, the applicant
was charged with AWOL (970405-970414); assaulting a PFC; unlawfully
entering a barracks room with the intent to commit a criminal offense;
committing an indecent assault upon SPC by wrestling her to the floor,
forcing her to her stomach, and while clothed rubbing his erect penis on
her buttocks; disorderly conduct; wrongfully having sexual intercourse with
a SPC, not his wife; and, attempting to rape a SPC. On 17 June 1997, the
applicant consulted with legal counsel and voluntarily requested, in
writing, discharge under the provisions of Chapter l0, AR 635-200 in lieu
of trial by court-martial. In this request, the applicant admitted guilt
to the offenses, or lesser included offenses. Further, the applicant
indicated that he understood that he could receive an under other than
honorable conditions discharge and that the discharge would have a
significant effect on eligibility for veteran’s benefits. The applicant
did not submit a statement in his own behalf. The unit commander
recommended approval of an under other than honorable conditions discharge.
On 9 August 1997, the separation authority approved the discharge with an
under other than honorable conditions discharge. The applicant was to be
reduced to the lowest enlisted rank.
b. On 12 September 1997, the applicant was discharged. At the time
of discharge, the applicant had completed 2 years, 6 months, and 4 days of
active military service and 10 days lost time due to AWOL in the period
under review and had a total of 7 years, 9 months, and 12 days military
service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt. Army policy states
that although an honorable or general discharge is authorized, a discharge
UOHC is normally considered appropriate.

(2) The issue is accepted. The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses. Notwithstanding the propriety of the
discharge, the Board noted that the applicant served for over 7 years,
attained the grade of specialist/E-4, and received a Joint Service
Commendation Medal and Army Achievement Medal prior to the incidents which
led to his discharge. In view of the above, the circumstances surrounding
the discharge, and the elapsed time, the Board found that the discharge was
inequitable. Accordingly, the Board voted to grant relief in the form of
an upgrade of characterization of service to fully honorable and a change
to the narrative reason to Secretarial Authority. This action entails a
change in RE code to 1.
