PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 3 November 1995, the applicant was diagnosed with a personality disorder of: borderline personality disorder within the meaning of ICD-9-CM, AR 40-501, AR 635-200 and DSM-IV, the condition is a deeply ingrained, maladapted pattern of behavior of long duration. The unit commander notified the applicant of initiation of separation action under the provisions of Chapter 5, AR 635-200, by reason of personality disorder, with an honorable discharge. She was advised of her rights. The applicant submitted a statement in her own behalf. The unit commander subsequently recommended separation from the service. The separation authority waived further rehabilitation efforts and directed that the applicant be discharged with a characterization of service of honorable.

         b. On 8 January 1996, the applicant was discharged. At the time of discharge, the applicant had completed 1 year, 10 months, and 15 days of active military service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-13 provides that a soldier may be separated for personality disorder, not amounting to disability under Army Regulation 635-40, that interferes with assignment to or performance of duty. The regulation requires that the condition is a deeply ingrained maladaptive pattern of behavior of long duration that interferes with the soldiers ability to perform duty. The regulation also directs that commanders will not take action prescribed in this chapter in lieu of disciplinary action, requires that the diagnosis concludes the disorder is so severe that the soldier’s ability to function in the military environment is significantly impaired, and states that separation for personality disorder is not appropriate when separation is warranted under chapter 4, 5, 7, 9, 10, 11, 13, 14, or 15; Army regulation 604-10 or Army Regulation 635-40. Army policy requires the award of a fully honorable discharge in such cases.

(1-2) The issues are rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The evidence of record shows that competent medical authority diagnosed the applicant with a borderline personality disorder within the meaning of ICD-9-CM, AR 40-501, AR 635-200 and DSM-IV. Based on the forgoing diagnosis, the applicant’s commanding officer appropriately initiated the applicant’s separation under the provisions of Chapter 5, Paragraph 5-13, AR 635-200, by reason of a personality disorder with issuance of a characterization of service of Honorable. Additionally, the Board noted that, upon separation, the applicant was appropriately assigned a reentry eligibility (RE) code of 3. If the applicant desires to reenlist, she should contact the local recruiter to determine her eligibility to reenlist. Those individuals can best advise a former service member as to the needs of the Army at the time, and are required to process waivers of RE codes. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.

         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
