PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 26 October 1994, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 5, AR 635-200, personality disorder, with a recommendation for an honorable discharge (HD). The applicant was advised of his rights, declined legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval. On 7 November 1994, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an HD.

         b. On 14 November 1994, the applicant was discharged with an HD. At the time of discharge the applicant had completed 4 years and 27 days of active military service.

         c. The applicant’s record shows that he completed just over 4 years of service; that he attained the rank of specialist/E-4; that he completed an overseas tour in Germany; and that he earned an Army Commendation Medal, a Good Conduct Medal, the National Defense Service Medal, and the Overseas Service Ribbon. There is no evidence of court-martial or nonjudicial punishment contained in the record. The applicant was diagnosed with a personality disorder after being hospitalized for a suicide threat. The psychiatric evaluation resulted in a recommendation that the applicant be administratively separated as soon as possible. The unit commander after consultation with and on the recommendation of competent medical authority processed the applicant for separation by reason of personality disorder.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-13 provides that a soldier may be separated for personality disorder, not amounting to disability under Army Regulation 635-40, that interferes with assignment to or performance of duty. The regulation requires that the condition is a deeply ingrained maladaptive pattern of behavior of long duration that interferes with the soldiers ability to perform duty. The regulation also directs that commanders will not take action prescribed in this chapter in lieu of disciplinary action, requires that the diagnosis concludes the disorder is so severe that the soldier’s ability to function in the military environment is significantly impaired, and states that separation for personality disorder is not appropriate when separation is warranted under chapter 4, 5, 7, 9, 10, 11, 13, 14, or 15; Army regulation 604-10 or Army Regulation 635-40. Army policy requires the award of a fully honorable discharge in such cases.

(1), (2), and (3) The issues are rejected. The Board noted the applicant’s contentions that, in effect, the narrative reason for his discharge is unfair because it was based on an isolated incident which resulted from the death of his father and marital conflicts; that several doctors have since indicated that he is fine and that at the time of his discharge he was overwhelmed with stress; and that medical authorities cleared him to enter the National Guard, where he now serves. The Board noted that the applicant was discharged for a personality disorder under the provisions of Chapter 5, AR 635-200 only after being diagnosed with a personality disorder by competent medical authority, who recommended an administrative separation. The Board congratulates the applicant on his recovery and acceptance into the National Guard; however, this does not call into question the original diagnosis or provide the Board a basis for relief. Further, the Board concluded that the quality of the applicant’s overall record of service for the period of enlistment under review was appropriately recognized with an honorable characterization of service. The Board, being convinced that the reason for discharge was proper and equitable, voted to deny the applicant’s request for a change in reason for discharge.
