PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. The evidence of record shows that on 1 April 1997, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 5, AR 635-200, for personality disorder, with a recommendation for an honorable discharge (HD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval with an HD. On
5 April 1997, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an HD.
         b. On 15 April 1997, the applicant was discharged with an HD. At the time of his discharge the applicant had completed 1 year, 1 month, and 9 days of active military service.

         c. The applicant’s record shows that he completed just over a year of service and the highest rank he attained while on active duty was private/E-2. There are no documented acts of valor, significant achievement, or service warranting special recognition contained in the record. On 12 February 1997, the applicant underwent a psychiatric evaluation based on his attempting suicide. The evaluation resulted in a diagnosis that the applicant suffered from an occupational problem and an adjustment disorder. The psychiatric recommendation was that an administrative separation would be in the best interest of the applicant and the Army. Based on this evaluation the applicant’s unit commander recommended that the applicant be separated by reason of personality disorder, under the provisions of Chapter 5, AR 635-200 which was ultimately approved.

 2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-13 provides that a soldier may be separated for personality disorder, not amounting to disability under Army Regulation 635-40, that interferes with assignment to or performance of duty. The regulation requires that the condition is a deeply ingrained maladaptive pattern of behavior of long duration that interferes with the soldiers ability to perform duty. The regulation also directs that commanders will not take action prescribed in this chapter in lieu of disciplinary action, requires that the diagnosis concludes the disorder is so severe that the soldier’s ability to function in the military environment is significantly impaired, and states that separation for personality disorder is not appropriate when separation is warranted under chapter 4, 5, 7, 9, 10, 11, 13, 14, or 15; Army regulation 604-10 or Army Regulation 635-40. Army policy requires the award of a fully honorable discharge in such cases.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.
         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1) The issue is rejected. The Board noted the applicant’s contention that his discharge was inequitable because the statements made regarding a suicide attempt were overstated, and that he would now like his reentry eligibility (RE) code changed in order to join the Navy. However, the Board noted that the applicant was properly and equitably discharged for a personality disorder under the provisions of Chapter 5, AR 635-200 and was awarded an appropriate RE code in accordance with applicable regulations. Further, the Army Discharge Review Board cannot change the applicant’s reentry eligibility (RE) code. To obtain a change in an RE code, the applicant should provide supporting documentation to justify any change and submit the request to the Commander, US Army PERSCOM, ATTN: TAPC-EPR-P, 2461 Eisenhower Avenue, Alexandria, Virginia 22331-0450. To obtain a waiver for reenlistment, the applicant should contact a local recruiter for assistance. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
