                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 9 February 1993, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory
performance, with general, under honorable conditions discharge.  The
reasons for the proposed action were his conduct and performance had been
below the acceptable standards required for continuous service.  He
constantly failed to go at the time prescribed to his appointed place of
duty, leading to the administration of two company grade Article 15s.  He
also had an incident of breaking restriction, leading to his apprehension
by the civilian authorities for operating a vehicle while under the
influence of alcohol.  He was advised of his rights.  The applicant waived
his right to legal counsel, was advised of the impact of the discharge
action, and did not submit a statement in his own behalf.  On 10 February
1993, the unit commander recommended separation from the service and waiver
of further rehabilitative efforts.  On 17 February 1993, the separation
authority waived further rehabilitative efforts and directed that the
applicant be discharged with a characterization of service of general,
under honorable conditions.

      b.  On 24 February 1993, the applicant was discharged.  At the time
of discharge, the applicant had completed 2 years, 8 months, and 7 days of
active military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 13 contains the policy and outlines the procedures for separating
individuals for unsatisfactory performance, to include separation for those
individuals who fail to maintain Army physical standards.  Initiation of
separation proceedings is required for individuals without medical
limitations who have two consecutive failures of the Army physical fitness
test or who are eliminated for cause from Noncommissioned Officer Education
System courses unless the responsible commander chooses to impose a bar to
reenlistment per AR 601-280.  Service of individuals separated because of
unsatisfactory performance will be characterized as honorable or under
honorable conditions as warranted by their military records.

        (2)  The issue is accepted.  The Board noted that the government
introduced a document into the discharge process revealing that the
applicant had self-referred to the Alcohol and Drug Prevention and Control
Program for substance abuse.  This is limited use information as defined in
Chapter 6, AR 600-85.  Use of this information mandates award of a fully
honorable discharge.  Accordingly, the Board voted to change the
characterization of service to fully honorable.  However, the board found
that the reason for discharge was fully supported by the record and voted
not to change it.

      b.  Equity:      The parenthetical number(s) below correspond(s) to
