PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. The evidence of record shows that on 18 April 1997, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 11, AR 635-200 by reason entry level status, with an uncharacterized discharge. She was advised of her rights. The applicant acknowledged notification, consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement on her own behalf. The unit commander subsequently recommended approval with an uncharacterized discharge and forwarded it through command channels to the separation authority. On
21 April 1997, the separation authority directed that the applicant be discharged with an uncharacterized discharge.

         b. On 22 April 1997, the applicant was discharged. She was credited with
5 months, and 16 days active service on the enlistment under review.

         c. The unit commander indicated that he was initiating separation action under the provisions of Chapter 11, AR 635-200, because the applicant failed to adapt to a military environment. She received a field grade Article 15 while at AIT for failing to obey; making telephone calls to a permanent party soldier; meeting with a permanent party member for private entertainment; disobeying an order; and, disrespect to a noncommissioned officer. Further, she used provoking and threatening words toward fellow soldiers.

 2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of this regulation, in effect at the time, provided, for the separation of personnel due to unsatisfactory performance, conduct, or both, while in an entry level status. This provision of regulation applied to individuals who had demonstrated that they were not qualified for retention because they could not adapt socially or emotionally to military life, or because they lacked the aptitude, ability, motivation or self discipline for military service, or that they had demonstrated characteristics not compatible with satisfactory continued service. The separation policy applies to soldiers who cannot meet the minimum standards prescribed for successful completion of training because of lack of aptitude, ability, motivation or self-discipline. The regulation requires uncharacterized service for separation under this chapter.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (1) The issue is rejected. The Board carefully reviewed the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board noted the applicant’s contention that she voluntarily left the Army because of her pregnancy, however, the evidence of record does not support the applicant’s contention and no evidence, has been submitted by her to support it. The record shows that the applicant received an uncharacterized separation while in an entry level status (ELS) for multiple incidents of misconduct. The separation authority approved the applicant's discharge as entry level status, with the description of service as uncharacterized. A soldier is in entry level status for the first 180 days of continuous active duty. The purpose of the entry level status is to provide the soldier a probationary period. Soldiers who are found to lack the necessary motivation, adaptability, self-discipline, ability, or attitude to become productive soldiers may be expeditiously separated while in entry level status. An honorable discharge is rarely ever granted for an ELS. A fully honorable discharge may be granted only in cases which are clearly warranted by unusual circumstances involving outstanding personal conduct and/or performance of duty. The Board determined that no such unusual circumstances were present in the applicant’s record and his service did not warrant an honorable discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
