PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 5 June 1998, the unit commander notified the applicant of initiation of separation action under the provisions of
Chapter l4, AR 635-200, by reason of misconduct, with a general, under honorable conditions (GD) discharge. She was advised of her rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement on her behalf. The unit commander subsequently recommended separation from the Army. On 7 July 1998, the separation authority directed that the applicant be discharged with a GD.

         b. On 17 July 1998, the applicant was discharged with a general, under honorable conditions discharge. At the time of discharge, the applicant had
2 years, 7 months, and 20 days service on her current enlistment.

         c. The applicant's unit commander indicated that the factual reasons for the action recommended were, in effect, that the applicant's conduct had been detrimental to the good order and conduct of the unit as evidenced by the substandard performance of her duties; that she was insubordinate and disrespectful to an NCO and a Warrant officer; that she missed assigned CQ duty; that she violated restriction parameters; and that she failed to obey an order.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (1), (2), and (3) The issues are rejected. The Board carefully examined the applicant's record of service for the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board determined that the applicant's discharge was appropriate because the quality of service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that the applicant’s service mitigated the misconduct or poor duty performance. Additionally, the Board noted that the latest document received by the applicant from the Department of Veterans Affairs, correctly informed her that due to her receiving a general discharge, she was not entitled to education benefits under the provisions of the Montgomery GI Bill. Furthermore, eligibility for veteran's benefits to include educational benefits under the Montgomery GI Bill does not fall within the purview of the Army Discharge Review Board. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
