PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 30 October 1995, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct, with a general, under honorable conditions discharge (GD). The applicant was advised of her rights, acknowledged notification of the action, waived legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in her own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 9 November 1995, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 13 November 1995, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 3 years, 7 months, and 13 days of active military service.

         c. The applicant’s record reflects that she had completed over 3 and ½ years of a 4 year enlistment and that the highest rank she achieved while on active duty was specialist/E-4. The applicant received a Good Conduct Medal after completing 3 years of service; however, there are no other documented acts valor, significant achievement, or service warranting special recognition contained in the record. There is, however, an extensive history of disciplinary infractions which include the applicant’s conviction by summary court-martial for failing to report to her prescribed place of duty. Her sentence included a reduction in rank to private/E-2. The applicant was processed for separation for a pattern of misconduct. The unit commander cited the following incidents as the basis for taking the action: 20 January 1995 the applicant was counseled for her failure to follow instructions and to report back to work; On 6 February 1995 she was counseled for falsifying an official statement; on 30 May 1995 she was counseled for missing guard mount; on 30 August she was tried and convicted by summary court-martial as outlined above; and on 12 September 1995 she was counseled by her unit commander for her numerous incidents of misconduct over a two year period and she was advised by the commander of his intent to process her for separation.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

(1), (2), and (3) The issues are rejected. The Board noted the applicant’s contention that her discharge was improper because the original charges were dropped and then reworded at JAG; that her discharge was based on her losing a pager which was later recovered; and that it was based on an effort to get her and her roommate out of the service. However, the record reflects that the applicant was not discharged based on one charge but rather based on a pattern of misconduct cited by the unit commander in his action to separate the applicant and which was well documented in the record. Further, the Board found no evidence of arbitrary or capricious actions by the command. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.

(4) The issue is rejected. The Board noted the applicant’s contention that her discharge was unfair because she was sent into the world with no unemployment benefits or education benefits which she paid for. However, the Board concluded that these factors did not mitigate the applicant’s misconduct sufficiently to warrant relief; thus, provided no basis on which to grant relief. Eligibility for unemployment benefits and veteran's benefits, to include educational benefits under the Montgomery GI Bill, does not fall within the purview of the Army Discharge Review Board. Accordingly, the applicant should contact a local office of the Department of Veterans Affairs for further assistance with these issues.
