PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 28 October 1998, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—commission of a serious offense, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, declined legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The intermediate commanders reviewed the proposed discharge action and recommended approval of the separation action with a GD. The separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 4 November 1998, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 2 years, 1 month, and 4 days of active military service.

         c. The applicant’s record shows that he completed over 2 years of service and the highest rank he attained while on active duty was private/E-2. His disciplinary record includes his acceptance of four Article 15’s: the first on
6 July 1997, for wrongfully purchasing and drinking vodka which resulted in his reduction to private/E-1; the second on 29 January 1998, summarized, for failure to obey a lawful general regulation; the third on 6 February 1998, summarized, for being incapacitated for the proper performance of his duty due to previous overindulgence of liquor or drugs; and the fourth on 26 August 1998, for being physically in control of a vehicle while impaired by alcohol which resulted in his reduction to private/E-1. The record also shows that on 28 September 1998 the applicant was tried and convicted by Summary Court-Martial for 15 violations of Articles 89, 91, 92,128, and 134 of the UCMJ. He was sentenced to 30 days of confinement and a forfeiture of $600.00. The unit commander processed the applicant for separation for the commission of a serious offence, citing the applicant’s disrespect to an NCO, willful disobedience to an NCO, assault of an NCO, and failure to comply with general regulations as the basis for the action.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.
