PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The applicant’s separation packet is not contained in the available records. There is, however, a properly constituted DD Form 214 (Certificate of Release or Discharge from the Regular Army), authenticated by the applicant, which documents the following: Character of Service-General, Under Honorable Conditions; Authority for Separation-Chapter 14, AR 635-200; Narrative reason for Separation-Misconduct. The record also contains Orders Number 222-0001,issued by Department of the Army Headquarters, 5 th Personnel Service Battalion, Fort Polk, Louisiana, dated 10 August 1998 which discharged the applicant from the Regular Army, effective date: 17 August 1998.

         b. On 17 August 1998, the applicant was discharged with a general, under honorable conditions discharge. At the time of discharge, the applicant had
completed 2 years, 5 months, and 19 days of active military service.

         c. The record shows the applicant completed almost 2 and ½ years of service and the highest rank she attained while on active duty was private first class/
E-3. There is no evidence of acts of valor, significant achievement, or service warranting special recognition contained in the available records. Likewise, the available records do not contain the applicant’s disciplinary record.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

 (1) The issue is rejected. The Board noted the applicant’s contention that alcohol impaired her ability to serve and that she tried to get help for her problem. The available records do not contain the specific facts and circumstances concerning events that led to the applicant’s discharge from the Army. However, the Board noted that the applicant’s record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. This document identifies the reason and characterization of the discharge and the Board presumed government regularity in the discharge process. The Board, being convinced that the reason for discharge and the characterization of service were proper and equitable, voted to deny relief.
