PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The available records are limited and do not provide a completed record of the applicant’s service. However, the record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), authenticated by the applicant, which documents the following: Authority for Separation-AR 635-200, Chapter 4; Narrative reason for Separation- Completion of Required Active Service; Characterization of Service-Honorable; Separation (SPD) Code-LBK; and Reentry (RE) code 3.

         b. On 2 December 1993, the applicant was separated with an honorable discharge. At the time of his discharge he had completed 2 years, 3 months, and 27 days of active military service.
         c. While the available records do not contain the applicant’s disciplinary history, procedurally, under applicable regulations the applicant could not have been assigned an RE code of 3 unless he was not qualified for continued Army service. Whatever the disqualification, the applicant remains eligible for a waiver of the his RE code. The DD Form 214 contained in the record was authenticated by the applicant and there is no evidence that an objection to the RE code was raised at the time of separation.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200, in effect at the time, set forth the basic authority for separation of enlisted personnel. Chapter 4 of that regulation provided, in pertinent part, for the separation of individuals at ETS. An individual discharged by reason of ETS could receive a GD or an HD depending on his record of service.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.
         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1) The issue is rejected. The Board noted the applicant’s contention that, in effect, he was separated at the completion of his term of service and should not have received an RE code of 3. However, the Board noted that the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. This document identifies the assigned reentry eligibility (RE) code and the Board presumed government regularity in the discharge process. The Army Discharge Review Board cannot change the applicant’s RE code. To obtain a change in an RE code, the applicant should provide supporting documentation to justify any change and submit the request to the Commander, US Army PERSCOM, ATTN: TAPC-EPR-P, 2461 Eisenhower Avenue, Alexandria, Virginia 22331-0450. To obtain a waiver for reenlistment, the applicant should contact a local Army recruiter for assistance. The Board, being convinced that the reason for discharge was both proper and equitable, voted not to change it.
