SECTION A-ANALYSTS ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 5 December 1996, DA, HQ, 101th Mountain Division (Light Infantry) and Fort Drum, New York, Orders 340-1020 discharged the applicant from the Regular Army, effective 13 December 1996. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty). His DD Form 214 indicates that he was discharged under the provisions of Chapter 13, AR 635-200 by reason of unsatisfactory performance, with a characterization of service of general, under honorable conditions. The specific facts and circumstances pertaining to the applicants discharge are not contained in the available records.
b. On 13 December 1996, the applicant was discharged. At the time of discharge, the applicant had completed 2 years, 9 months, and 26 days of active military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. (1) The issue is rejected. The applicants record is void of facts and circumstances concerning events that led to a discharge from the Army. The Board noted that the applicants record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. The evidence shows that the applicant was discharged under the provisions of Chapter 13, AR 635-200, by reason of unsatisfactory performance with a characterization of service of general, under honorable conditions. In the absence of evidence to the contrary, the Board presumed administrative regularity in the discharge process. The Board, being convinced that the reason for the discharge and the characterization of service were both proper and equitable, voted to deny relief.
