PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

	a.  Evidence of record shows that on 19 June 2001, DA, U.S. Army Field Artillery Center and Fort Sill, Oklahoma, Orders 170-0087 released the applicant from active duty for training, and discharged him from the Reserve of the Army, effective 20 June 2001.  The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicant’s signature.  His DD Form 214 indicates that he was released under the provisions of Chapter 5, AR 635-200 by reason of failure to meet procurement medical fitness standards, with a characterization of service of uncharacterized.  The specific facts and circumstances pertaining to the applicant’s discharge are not contained in the available records.  

	b.  On 20 June 2001, the applicant was released from active duty.  At the time of release, the applicant had completed 1 month, and 18 days of active military service in the period under review and had a total of 5 months and 1 day of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel.  Paragraph 5-18 provides that a soldier has a physical or mental condition that potentially interferes with assignment to or performance of duty, the commander will refer that soldier for a medical examination and/or mental status evaluation in accordance with AR 40-501, and excluding conditions appropriate for separation processing under paragraphs 5-11 or 5-13.
