2. Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

        
         a. Propriety:    The parenthetical numbers below corresponds to the issue numbers on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The record does not support the applicant's contention, and no evidence to support it has been submitted by the applicant, that at the time of his discharge he was not informed of its ramifications. The separation packet contains the applicant’s signature indicating he was advised by a consulting counsel of: the basis of the contemplated action to accomplish his separation; the effects of any action taken by him in waiving his rights; and that he may expect to encounter substantial prejudice in civilian life as a result of the issuance of a general discharge under honorable conditions.

         b. Equity:       The parenthetical numbers below corresponds to the issue numbers on the DD Form 293, or in Part VI, Paragraph 1, above.

(1, 2) The issues are rejected. The applicant's discharge was appropriate because the quality of service determination at the time of discharge was consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. By misconduct and poor duty performance the applicant diminished the quality of service below that meriting a fully honorable discharge. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or the applicant’s service mitigated the misconduct or poor duty performance. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
