THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that his DD Form 214 (Certificate of Release or Discharge from Active Duty) dated 31 August 2010 be corrected to reflect his correct deployments to imminent danger areas.

2.  The applicant states, in effect, that his DD Form 214 does not reflect in item 18 (Remarks) the correct dates of his deployments to imminent danger areas.  He also states that the entry “Service in Qatar 19920307 – 19950208” should reflect service in Germany, that the DD Form 214 is missing the entry “Service in Qatar 20071108 – 20071206,” and the entry for service in Afghanistan should read “20090220 – 20090406.”  He did not have time to review his DD Form 214 at the time of retirement and he desires credit for his deployments for purposes of applying for a government civilian position.

3.  The applicant provides a list of supporting documents submitted with his application on page five of his application.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 31 October 1989.  He completed his one-station unit training as a human resources specialist.  He deployed to Southwest Asia (SWA) during the period 19900912 – 19910407.

2.  He remained on active duty through a series of continuous reenlistments and served a tour in Germany during the period 19920307 – 19950208.  He was promoted to the pay grade of E-7 on 1 September 2006.
3.  The available evidence shows the applicant made the following deployments:

* SWA 19900912 – 19910407
* Qatar 20071109 – 20071205
* Qatar 20090114 – 20090219
* Afghanistan 20090220 – 20090406
* Qatar 20090407 – 20090425
* Qatar 20090718 - 20090904

4.  On 31 August 2010, the applicant was retired by reason of sufficient service for retirement.  He had served 20 years and 10 months of active service and his DD Form 214 issued at the time of his retirement shows in item 18 the following deployments:

* SWA 19900912 – 19910407
* Qatar 19920307 – 19950208
* Qatar 20090114 – 20090219
* Afghanistan 20090220 – 20090425
* Qatar – 20090718 - 20090904

5.  Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It established standardized policy for preparation of the DD Form 214 and provides for item 18 for an active duty Soldier deployed to a foreign country with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)."

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s contention that his deployments are not properly reflected on his DD Form 214 has been noted and found to have merit.  While his assignment to Germany was not a deployment and not authorized for entry as a deployment, the remaining deployments should be corrected by deleting the following entries from item 18 of his DD Form 214 for the period ending 31 August 2010:

* Qatar 19920307 – 19950208
* Qatar 20090114 – 20090219
* Afghanistan 20090220 – 20090425


2.  Additionally, the following entries should be added to item 18 of his DD Form 214 for the period ending 31 August 2010:

* Qatar 20071109 – 20071205
* Qatar 20090114 – 20090219
* Afghanistan 20090220 – 20090406
* Qatar 20090407 – 20090425
* Qatar 20090718 - 20090904

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

a.  By deleting the following entries from item 18 of his DD Form 214 for the
period ending 31 August 2010:

* Qatar 19920307 – 19950208
* Qatar 20090114 – 20090219
* Afghanistan 20090220 – 20090425

b.  By entering the following entries in item 18 of his DD Form 214 for the
period ending 31 August 2010:

* Qatar 20071109 – 20071205
* Qatar 20090114 – 20090219
* Afghanistan 20090220 – 20090406
* Qatar 20090407 – 20090425
* Qatar 20090718 - 20090904

2.  The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to adding his tour in Germany as a deployment. 

3.  The Board wants the applicant and all others to know that the sacrifices he made in service to the United States during the Global War on Terrorism are deeply appreciated.  The applicant and all Americans should be justifiably proud of his service in arms.
