THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests his dates of deployment be added to item 18 (Remarks) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) with a separation date of 30 December 2008.  He also requests the following awards be added to his DD Form 214:

* Army Commendation Medal
* Iraq Campaign Medal
* Global War on Terrorism Service Medal
* Combat Action Badge

2.  The applicant states he was in Iraq from 15 May to 5 December 2007.

3.  The applicant provides:

* deployment orders
* Army Commendation Medal Certificate
* Order of the Combat Spur Certificate
* orders for award of the Combat Action Badge
* Enlisted Record Brief, dated 20 November 2008

CONSIDERATION OF EVIDENCE:

1.  He enlisted in the Regular Army on 9 November 2006 for a period of 3 years and 21 weeks.  He completed basic combat and advanced individual training and was awarded military occupational specialty 19D (Cavalry Scout).

2.  Headquarters, 1st Cavalry Division (Provisional) (Rear), Fort Hood, TX, Orders 123-01, dated 3 May 2007, deployed the applicant's unit in a temporary change of station for Operation Iraqi Freedom (OIF).

3.  Headquarters, 3rd Brigade, 1st Cavalry Division, Permanent Order Number 309-022, dated 5 November 2007, awarded the applicant the Army Commendation Medal.

4.  Headquarters, 1st Armored Division, Multinational Division North, Contingency Operating Base Speicher, Iraq, Permanent Order 326-015E, dated 22 November 2007, awarded the applicant the Combat Action Badge for action on 1 September 2007.

5.  On 30 December 2008, he was discharged.  He completed 2 years and 23 days of active service that was characterized as under honorable conditions.  Item 24 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows he was awarded or is authorized the:

* National Defense Service Medal
* Army Service Ribbon

6.  An email from the Defense Finance and Accounting Service (DFAS), dated 17 February 2011, states the applicant received hostile fire/imminent danger pay (HF/IDP) and combat zone tax exclusion (CZTE) from 11 May 2007 May through 10 December 2007.

7.  Army Regulation 600-8-22 (Military Awards) states the Iraq Campaign Medal is awarded to members who served in direct support of OIF.  The area of eligibility encompasses all the land area of the country of Iraq, the contiguous water area out to 12 nautical miles, and all air spaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles.  The Iraq Campaign Medal period of eligibility is on or after 19 March 2003 to a future date to be determined by the Secretary of Defense or the cessation of OIF.  A bronze service star is authorized for wear with this medal for participation in each credited campaign.  Approved campaigns included the Iraqi Surge (10 January 2007-31 December 2008).

8.  Army Regulation 600-8-22 states the Global War on Terrorism Service Medal is authorized for award to members of the Armed Forces of the United States who participated in Global War on Terrorism operations outside of the areas of eligibility designated for award of the Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Iraq Campaign Medal.  All Soldiers on active duty, including Reserve Component Soldiers mobilized or National Guard Soldiers activated, on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized the Global War on Terrorism Service Medal.

9.  Army Regulation 635-5 (Separation Documents) provides that when an active duty Soldier is deployed with his unit during the period covered by the DD Form 214, an entry will be made in item 18 to show the name of the country deployed to and the inclusive dates in YYYY/MM/DD format.

DISCUSSION AND CONCLUSIONS:

1.  The email from DFAS shows he received HF/IDP and CZTE for Kuwait from 11 May to 10 December 2007.  He states he was actually in Iraq from 15 May to 5 December 2007.  Therefore, it would be appropriate to add the entry "Iraq 20070515 to 20071205" to item 18 of his DD Form 214.

2.  Orders show he was awarded the Army Commendation Medal and the Combat Action Badge.  Therefore, these awards should be added to his DD Form 214.

3.  Based on his service he is authorized the Global War on Terrorism Service Medal and based on his service in Iraq he is authorized the Iraq Campaign Medal with one bronze service star.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the entry, "IRAQ 20070515 TO 20071205" to item 18 of his DD Form 214.

2.  The Board further recommends his records be corrected by adding the following awards to item 24 of his DD Form 214:

* Army Commendation Medal
* Iraq Campaign Medal with one bronze service star
* Global War on Terrorism Service Medal
* Combat Action Badge
