THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Army Commendation Medal with 3rd Oak Leaf Cluster (OLC) and Presidential Unit Citation.
2. The applicant states the awards were not completed at the time of his discharge.
3. The applicant provides copies of the following:
* Permanent Orders (PO) Number 299-16
* DA Form 638 (Recommendation for Award) for Army Commendation Medal with 3rd OLC
* DD Form 214
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the Regular Army on 9 July 2007. He served in military occupational specialty 11B (infantryman). He was assigned to the 1st Battalion, 502nd Infantry Regiment. He served in:
* Iraq from 27 December 2007 through 24 November 2008
* Afghanistan from 9 May 2010 through 23 April 2011
2. He provided copies of the following:
* PO Number 299-16 issued by the U.S. Army Human Resources Command on 25 October 2012 announcing award of the Presidential Unit Citation to the 1st Battalion, 502nd Infantry Regiment, for the period
16 to 26 November 2010
* DA Form 638 which recommended him for award of the Army Commendation Medal with 3rd OLC for outstanding meritorious service from 14 November 2007 through 29 July 2013; this award was approved by PO Number 161-005 on 9 July 2013
3. He was honorably released from active duty in pay grade E-6 on 31 July 2013 and he was transferred to the U.S. Army Reserve Control Group (Reinforcement). He was credited with completing 6 years and 22 days of net active service. His DD Form 214 lists the:
* Afghanistan Campaign Medal with one bronze service star
* Army Commendation Medal (3rd Award)
* Army Achievement Medal (2nd Award)
* Meritorious Unit Commendation
* Valorous Unit Award
* Army Good Conduct Medal
* National Defense Service Medal
* Global War on Terrorism Service Medal
* Iraq Campaign Medal with one bronze service star
* Noncommissioned Officer Professional Development Ribbon (2nd Award)
* Army Service Ribbon
* Overseas Service Ribbon (2nd Award)
* North Atlantic Treaty Organization Medal
* Combat Infantryman Badge
* Pathfinder Badge
* Air Assault Badge
4. There is no evidence of any disciplinary actions or a commander's disqualification that would have precluded the applicant from being recommended for or awarded the second award of the Army Good Conduct Medal.
5. Army Regulation 600-8-22 (Military Awards) provides Department of the Army policy, criteria, and administrative instructions concerning individual military decorations, Army Good Conduct Medal, service medals and ribbons, combat
and special skill badges and tabs, unit decorations, and trophies, and similar devices awarded in recognition of accomplishments. The regulation states the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified.
DISCUSSION AND CONCLUSIONS:
1. PO awarded the applicant the Army Commendation Medal with 3rd OLC (4th Award) and his unit the Presidential Unit Citation during his period of service. Therefore, he is entitled to correction of his DD Form 214 to show these awards.
2. The evidence appears to show he met the criteria for a second award of the Army Good Conduct Medal. There is no evidence that any disciplinary action was taken against him during his period of active service and no evidence that his commander disqualified him for the award. Therefore, it would be appropriate at this time to award him the Army Good Conduct Medal (2nd Award) for the period 9 July 2010 through 8 July 2013 and its addition to his DD Form 214.
