THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Combat Infantryman Badge.
2. The applicant states he was awarded the Combat Infantryman Badge but it is not shown on his DD Form 214 or Enlisted Record Brief.
3. The applicant provides:
* DA Form 638 (Recommendation for Award)
* Orders 77-160, dated 18 March 2003
CONSIDERATION OF EVIDENCE:
1. The applicant's records show he enlisted in the Hawaii Army National Guard (HIARNG) on 6 April 2001. He entered active duty for training (ADT) on 6 June 2002 and completed the required training for military occupational specialty 11B (Infantryman).
2. He was honorably released from ADT on 2 August 2002. The DD Form 214 he was issued shows the:
* Army Service Ribbon
* Sharpshooter Marksmanship Qualification Badge with Grenade Bar
* Marksman Marksmanship Qualification Badge with Rifle Bar
3. He was honorably discharged from the ARNG on 29 January 2003 for the purpose of enlistment in the Regular Army (RA). He subsequently enlisted in the RA for 3 years on 30 January 2003.
4. He served in Kuwait/Iraq, in support of Operation Iraqi Freedom (OIF), with
D Company, 3rd Battalion, 15th Infantry, from 1 September 2002 to 26 August 2003 and from 20 January 2005 to 19 December 2005.
5. Permanent Orders (PO) 322-108, issued by Headquarters, 2nd Brigade Combat Team, Baghdad, on 18 November 2005, awarded him the Army Commendation Medal for service from 21 January 2005 to 10 January 2006.
6. PO 075-055, issued by Headquarters, 2nd Brigade Combat Team, Baghdad, on 15 March 2006, awarded him the Army Commendation Medal for service from 9 March to 30 April 2006. The DA Form 638 listed the following achievements:
[Applicant] served in OIF I and OIF III as a M240 assistant gunner and rifleman. During combat operations during OIF I, [Applicant] participated in over 40 combat patrols in the enemy stronghold of Fallujah. His exposure under enemy fire and tactical abilities inspired young Soldiers.
While deployed to OIF III, [Applicant] participated in over 100 counter-insurgency patrols and over 30 humanitarian missions. During combat operations, he conducted security cordons, raids, and joint patrols with the newly-formed Iraqi Army.
7. He was honorably released from active duty on 30 April 2006. His DD Form 214 for this period of service listed awards of the:
* Army Commendation Medal
* Presidential Unit Citation
* Army Good Conduct Medal
* National Defense Service Medal
* Global War on Terrorism Service Medal
* Global War on Terrorism Expeditionary Medal
* Army Service Ribbon
* Overseas Service Ribbon
* Iraq Campaign Medal
8. He enlisted in the HIARNG on 4 May 2006. He was ordered to active duty on 19 August 2008 and subsequently served in Kuwait/Iraq from 31 October 2008 to 14 August 2009. He was honorably released from active duty on 29 November 2009. His DD Form 214 for this period of service listed awards of the:
* Iraq Campaign Medal with two bronze service stars
* Army Commendation Medal
* Army Good Conduct Medal
* National Defense Service Medal
* Global War on Terrorism Service Medal
* Global War on Terrorism Expeditionary Medal
* Iraq Campaign Medal with campaign star (listed twice)
* Army Service Ribbon
* Overseas Service Ribbon
* Armed Forces Reserve Medal with "M" Device
9. PO 288-001, issued by Headquarters, 1st Squadron, 299th Cavalry on 21 October 2010 awarded him the Army Achievement Medal.
10. He was ordered to active duty on 2 January 2011 and subsequently served in the Philippines (in support of Operation Enduring Freedom (OEF)) from 16 February 2011 to 10 August 2011. He was honorably released from active duty on 11 October 2011. His DD Form 214 for this period of service listed awards of the:
* Iraq Campaign Medal with two bronze service stars
* Army Commendation Medal
* Presidential Unit Citation
* Army Good Conduct Medal
* National Defense Service Medal
* Global War on Terrorism Service Medal
* Global War on Terrorism Expeditionary Medal
* Army Service Ribbon
* Overseas Service Ribbon (3rd Award)
* Overseas service bar (4th Award)
* Armed Forces Reserve Medal with "M" Device
* Marksmanship Qualification Badge with Grenade Bar
* Sharpshooter Marksmanship Qualification Badge with Rifle Bar
11. PO 254-19, issued by Headquarters, 29th Infantry Brigade Combat Team on 11 September 2011, awarded him the Army Commendation Medal for service from 17 February to 11 August 2011.
12. Army Regulation 600-8-22 (Military Awards) states there are basically three requirements for award of the Combat Infantryman Badge. The Soldier must be an infantryman satisfactorily performing infantry duties, he must be assigned to an infantry unit during such time as the unit is engaged in active ground combat, and he must actively participate in such ground combat.
13. Army Regulation 600-8-22 states the Iraq Campaign Medal is awarded to members who have served in direct support of OIF. The area of eligibility encompasses all the land area of the country of Iraq, the contiguous water area out to 12 nautical miles, and all air spaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles. The Iraq Campaign Medal period of eligibility is on or after 19 March 2003 to 31 December 2011. A bronze service star is authorized for wear with this medal for participation in each credited campaign. Approved campaigns are:
* Liberation of Iraq (19 March 2003-1 May 2003)
* Transition of Iraq (2 May 2003-28 June 2004)
* Iraqi Governance (29 June 2004-15 December 2005)
* National Resolution (16 December 2005-9 January 2007)
* Iraqi Surge (10 January 2007-31 December 2008)
* Iraqi Sovereignty (1 January 2009-31 August 2010
* New Dawn (1 September 2010 to 31 December 2011)
DISCUSSION AND CONCLUSIONS:
1. The applicant served in the ARNG and the RA. He deployed multiple times in support of OIF and/or OEF and received multiple DD Forms 214.
2. He held an infantry MOS and he served in Kuwait/Iraq with an infantry unit. His award of the Army Commendation Medal listed multiple achievements that confirm the applicant was personally present and under fire when his unit engaged the enemy. He met the criteria for and states he was awarded the Combat Infantryman Badge. As such, he should have his last DD Form 214 corrected to show this badge.
3. He was awarded two awards of the Army Commendation Medal, in 2005 and 2006, and he was awarded a third one in 2011. He was also awarded an Army Achievement Medal in 2010. Therefore, he is entitled to correction of his last
DD Form 214 to show all four awards.
