THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests removal of a DA Form 705 (Army Physical Fitness Test (APFT) Scorecard) from his Army Military Human Resource Record (AMHRR) (formerly known as the Official Military Personnel File).

2.  The applicant states the DA Form 705 was erroneously filed in his AMHRR.  It is not an authorized document for filing in the AMHRR.

3.  The applicant provides a copy of the DA Form 705, undated, that was issued when he was age 21.

CONSIDERATION OF EVIDENCE:

1.  The applicant was appointed as a Reserve commissioned officer in the rank of second lieutenant on 20 July 2010 and he was ordered to active duty on 7 November 2010.  He was born in July 1988.

2.  A review of the applicant's AMHRR contains the following pertinent documents:

	a.  A DA Form 705 that is filed in the service folder of his AMHRR (issued when the applicant was age 21 while attending the University of California-Davis).

	b.  A DD Form 4 (Enlistment/Reenlistment Document – Armed Forces of the United States), consisting of three pages with enclosures totaling 40 additional pages that constitute the applicant's accession packet, showing he enlisted as a cadet in the Senior Reserve Officers' Training Corps on 19 September 2008 for a period of 8 years.  (A DA Form 705 is not included in the accession packet.)

3.  A review of the applicant's records failed to reveal evidence that he contacted the official records custodian to request removal of the DA Form 705.

4.  Army Regulation 600-8-104 (Army Military Human Resource Records Management) provides policies, operating tasks, and steps governing the AMHRR.

	a.  Depending on the purpose, documents will be filed in the AMHRR in one of six folders:  performance, service, restricted, medical, other, or State/Territory.  Once placed in the AMHRR, the document becomes a permanent part of that file.

	b.  Table B-1 (Authorized Documents) provides guidance for filing the DA Form 705 and shows it will be filed in the service folder only as part of the ROTC accession packet.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends the DA Form 705 filed in his AMHRR should be removed because it is erroneously filed.

2.  The DA Form 705 that is filed in the service folder of the applicant's AMHRR is not filed as part of his ROTC accession packet.  Thus, the evidence of record shows the DA Form 705 is improperly filed in the applicant's AMHRR and it should be included as an enclosure to his DD Form 4 as part of his ROTC accession packet.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by removing the DA Form 705 filed in the service folder of his AMHRR and incorporate it as an enclosure to the DD Form 4 as part of his ROTC accession packet.

2.  In the event the above correction cannot be accomplished by the official records custodian, the DA Form 705 will be transferred to the restricted folder of the applicant's AMHRR.

3.  The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to removal of the DA Form 705 from his AMHRR.
