THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests a DA Form 705 (Army Physical Fitness Test (APFT) Scorecard), dated 6 June 2013, be removed from his Army Military Human Resource Record (AMHRR).  

2.  He states he deployed to Afghanistan on 26 April 2013 and was forced to take an APFT in June 2013 without adequate time to acclimate himself to the area.  He adds he had bronchitis when he took the test, but was unable to go to the medical facility due to the test being conducted prior to the medical facility opening.  He concludes he has since taken the APFT and passed.

3.  He provides his DA Form 705.

CONSIDERATION OF EVIDENCE:

1.  After being discharged as a Reserve Officers' Training Corps (ROTC) Cadet on 9 May 2009, the applicant was appointed as a Reserve Commissioned Officer in the U.S. Army.  He is currently serving in the U.S Army Reserve as a captain.  He deployed to Afghanistan on or about 26 April 2013.

2.  His record contains a DA Form 705 in the service section of his AMHRR that shows he was administered two APFTs.  Test One is dated 6 June 2013 and shows he was administered a "Diagnostic" APFT where he failed to achieve a passing score in the 2-mile run.  Test Two is dated 29 June 2013 and shows he was administered a "Record" APFT where he failed to achieve a passing score in the 2-mile run.
3.  Army Regulation 600-8-104 (Army Military Human Resource Records Management) provides that all personnel information recorded under the authority of this regulation is the property of the United States Government.

	a.  Once recorded, it will not be removed except as provided by law or this regulation.

	b.  Once placed in the AMHRR, the document becomes a permanent part of that file.  The document will not be removed from, or moved to, another part of the AMHRR unless directed by one or more of the following:

* Army Board for Correction of Military Records
* Department of the Army Suitability Evaluation Board 
* Chief, Appeals and Corrections Branch, U.S. Army Human Resources Command (HRC)
* AMHRR custodian when documents have been improperly filed
* Commander, HRC: ATTN: HRC-PDO-PO, as an approved policy change to this regulation
* Chief, Appeals Branch, National Guard Personnel Center

	c.  Appendix B of this regulation states that the DA Form 705 will be filed in the service section of the AMHRR only as part of an accession packet for ROTC.

DISCUSSION AND CONCLUSIONS:

The applicant's DA Form 705, contained in his AMHRR, shows he was administered two APFTs and failed both tests on 6 June 2013 and 29 June 2013. In accordance with Army Regulation 600-8-104 the DA Form 705 will be filed in the service section of the AMHRR only as part of an accession packet for ROTC. Therefore, it appears that this document is improperly filed and should be removed from his AMHRR.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by removing the DA Form 705 for APFTs conducted on 6 June and 29 June 2013 from his AMHRR.
