THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his Army Military Human Resource Record (AMHRR) to remove the Standard Form (SF) 312 (Classified Information Non-Disclosure Statement) and the DA Form 2-1 (Personnel Qualification Record-Part II).

2.  The applicant states he has two documents in his AMHRR on the interactive Personnel Electronic Records Management System (iPERMS) which are not authorized--the SF 312 and the DA Form 2-1.  According to Army Regulation 600-8-104 (Army Military Human Resource Records Management), both documents are only added to a Soldier’s file once they have been released from active duty.  He has been on continuous active duty since 1998; therefore, these documents should be deleted from his AMHRR.

3.  The applicant provides a self-authored Statement, dated 5 July 2013.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 11 September 1998.  He has served in a variety of stateside or overseas assignments and currently holds the rank/grade of sergeant first class (SFC)/E-7.

2.  iPERMS shows his SF 312 and DA Form 2-1 filed in the "Primary Folder" entitled "Service" and in an "Additional Folder" entitled "Administrative."

3.  Army Regulation 600-8-104 states in:
	a.  Chapter 4 (Management of Additional Folders and Documents in the iPERMS) that additional folders, aside from the AMHRR, are contained in iPERMS to assist the Army and other Government agencies in preserving valid information belonging to a Soldier for a specific period of time.  Non-AMHRR folders, which are referred to as "Additional Folders," are listed in table 4–1.  Documents authorized for filing in non-AMHRR folders are listed in appendix B. 

	b.  Table 4-1 (Non-AMHRR folders) states that the "Primary Folder" entitled "Administrative" is used to file DA level administrative documents not authorized for filing in the AMHRR.  

	c.  Paragraph 4–2 (Filing instructions for additional folders) states that "Additional Folders" contained in iPERMS that are not included in the AMHRR are the “DA Photograph” folder (PHOTO) and “Combat-Related Special Compensation” folder.  The DA Form 2-1 is included as a document authorized for inclusion in the “Combat-Related Special Compensation” folder in iPERMS.

	d.  Appendix B (Documents Authorized for Filing in the AMHRR and/or iPERMS) is a table that includes a compilation of all forms and documents which have been approved by DA for filing in the AMHRR and/or iPERMS.  The composition of the AMHRR and non-AMHRR folders is as shown in appendix B, "Primary Folder" column.  It is important to note that some documents are placed in multiple folders to assist records managers and official records custodians in Soldier management.  Appendix B shows that the:

* SF 312 is filed in the primary folder (Service), there are no specific filing instructions listed for this form
* DA Form 2-1 is filed in the primary folder (Service) and (Mobilization/Deployment), there are no specific filing instructions listed for this form

DISCUSSION AND CONCLUSIONS:

1.  A Soldier's AMHRR and iPERMS are not the same.  The AMHRR contains a specific set of folders, wherein only authorized documents may be filed.  iPERMS, however, contains a variety of documents that are not authorized to be filed in a Soldier’s AMHRR, and these documents are filed in "Additional Folders." 

2.  Army regulations state that the SF 312 and DA Form 2-1 are authorized to be filed in the service folder.  There are no specific instructions indicating when these forms are authorized for filing.  Additionally, both forms are filed in iPERMS in an "Additional Folder" entitled "Administrative."  The "Administrative" folder is a non-AMHRR file and is iPERMS specific.  This folder is used to file DA level administrative documents not authorized for filing in the AMHRR.  

3.  The SF 312 and DA Form 2-1 are not filed in the AMHRR; however, they are properly filed in iPERMS.  As such, there is insufficient justification to remove these documents.
