THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests removal of SGLV 8286A (Servicemen's Group Life Insurance (SGLI) Family Coverage Election) from his Army Military Human Resource Record (AMHRR), formerly known as the official military personnel file (OMPF).

2.  The applicant states the document was sent erroneously by the Human Resources Assistant at Fort Sam Houston, Texas.

3.  The applicant provides:

* Sponsor and Spousal Information from the Family Servicemembers' Group Life Insurance (FSGLI) Window Website
* SGLV 8286A, dated 14 January 2013
* Privacy Act Data Cover Sheet

CONSIDERATION OF EVIDENCE:

1.  With prior enlisted service, the applicant executed his Oath of Office as a second lieutenant in the Regular Army on 2 April 2009.

2.  The applicant was promoted to first lieutenant on 2 October 2010.

3.  On 29 October 2012, the applicant's spouse was notified by the Department of the Army (DA) of the following:

	a.  The National Defense Authorization Act of 2005 gave Soldiers the option to elect up to $400,000.00 worth of insurance effective 1 September 2005.

	b.  The Act also requires the U.S. Army to notify a Soldier's spouse whenever the Soldier designates a recipient(s) in addition to or in place of the Soldier's spouse, reduces the maximum SGLI coverage to a lesser amount, or declines coverage completely.

	c.  The SGLI is an insurance payment of up to $400,000.00 to the person(s) designated on the SGLV Form 8286.

	d.  The letter served as notice to her as the spouse of the applicant that on 29 October 2012 he elected to decline SGLI coverage completely.

	e.  Her spouse was entitled to make this election and nothing related to the notification requirement would affect the validity of such an election.

4.  The applicant was promoted to captain on 1 November 2012.

5.  On 14 January 2013, the applicant completed a SGLV 8286A electing no coverage for his spouse.  This document is filed in the Interactive Personnel Electronic Records Management System (iPERMS).

6.  Army Regulation 600-8-104 (AMHRR Management) prescribes policies governing the AMHRR Management Program.  Appendix B is the authority for documents authorized for filing in the AMHRR and/or iPERMS.  It states that        Table B-1 is a compilation of all forms and documents which have been approved by the DA for filing in the AMHRR and/or iPERMS.  The SGLV 8286A will be filed in the service and mobilization/deployment folder.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's contentions have been noted.  His supporting evidence has been considered.

2.  The applicable regulation states that the SGLV 8286A is an approved document for filing in the AMHRR and/or iPERMs.  Therefore, it was not erroneous to send this document for filing in iPERMS and it is properly filed therein.

3.  In view of the foregoing, the applicant's request should be denied.
