THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the correct period of his foreign service in Iraq.

2.  The applicant states he deployed to Iraq twice.  His first deployment was from 9 January 2008 to 30 December 2008; however, his DD Form 214 shows the beginning date as 9 October 2008.  He adds that his two 12-month deployments to Iraq are recorded on his Enlisted Record Brief (ERB) with the correct dates.

3.  The applicant provides a copy of his ERB and DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 23 May 2007 for a period of
3 years and 16 weeks.  He was awarded military occupational specialty 11C (Indirect Fire Infantryman).  In December 2009, he extended his enlistment for a period of 13 additional months.

2.  The applicant's ERB shows in section I (Assignment Information - Overseas/ Deployment Combat Duty):

* Iraq - 12 months from 9 January 2008 through 30 December 2008
* Iraq - 12 months from 6 July 2010 through 15 June 2011


3.  His DD Form 214 shows he was honorably released from active duty on 
11 October 2011 based on completion of required active service.  He completed 4 years, 4 months, and 19 days of total active service.  It also shows in:

   a.  item 12 (Record of Service), block f (Foreign Service):  "0000 years,
00 months, and 00 days"; and

	b.  item 18 (Remarks) shows, in part:

* "Service in Iraq 20081009-20081230"
* "Service in Iraq 20100706-20110615"

4.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active duty service or control of the Active Army and contains item-by-item instructions for completing the DD Form 214.  It shows for:

	a.  item 12f:  enter total amount of foreign service completed during the period covered in item 12c (Net Active Service This Period); and

	b.  item 18:  For an active duty Soldier deployed with his unit to a foreign country during their continuous period of active service enter:  "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)."

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that his DD Form 214 should be corrected to show his correct foreign service.

2.  The evidence of record shows the applicant served in Iraq from 9 January 2008 to 30 December 2008 and from 6 July 2010 through 15 June 2011.

   a.  A calculation of these two periods of overseas service shows the following:

	2008  12  30	date of redeployment
	- 2008  01  09	date of deployment to Iraq
	=     00  11  21
	+                   1	day inclusive
	=     00  11  22	total foreign service in Iraq (1st deployment)


	2011  06  15	date of redeployment
	- 2010  07  06	date of deployment to Iraq
	=     00  11  09
	+                   1	day inclusive
	=     00  11  10	total foreign service in Iraq (2nd deployment)

   b.  A calculation of the total amount of overseas service shows the following:

	00  11  22	service in Iraq (1st deployment)
	+ 00  11  10	service in Iraq (2nd deployment)
	= 00  22  32	or 1 year, 11 months, and 2 days of total foreign service

	c.  Item 12f and item 18 of the applicant's DD Form 214 do not show all of his foreign service.  Therefore, it would be appropriate to correct his DD Form 214 to show the correct period of his service in Iraq and all of his foreign service.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

   a.  deleting the current entry from item 12, block f of his DD Form 214 and adding the entry "0001  11  02"; and


   b.  correcting item 18 of his DD Form 214 by:

* deleting the entry:  "SERVICE IN IRAQ 20081009-20081230"
* adding the entry:  "SERVICE IN IRAQ 20080109-20081230"
