THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, retroactive award of Board Certification Pay (BCP) from 1 July 2012 through 30 September 2012. 

2.  The applicant states he just received his board certificate from the American Board of Radiology in the mail.  He was unable to back date pay prior to 1 October 2012 because of the beginning of a new fiscal year.  He has been board certified since 1 July 2012 and the specialty pay office cannot initiate his BCP for July through September 2012.

3.  The applicant provides:

* The American Board of Radiology certificate
* Exam Summary – Maintenance of Certification Exams
* request for BCP payment

CONSIDERATION OF EVIDENCE:

1.  The applicant was appointed in the U.S. Army Reserve as a second lieutenant effective 29 May 2003.

2.  The American Board of Radiology certified the applicant in Diagnostic Radiology effective 1 July 2012.

3.  His request for Medical Additional Special Pay beginning on 1 July 2012 was approved on 26 July 2012.
4.  In the advisory opinion, dated 13 May 2013, the Chief, Army Medical Department (AMEDD) Special Pay Branch, stated:

   a.  The applicant indicated he was requesting BCP retroactive for the 3-month period from 1 July 2012 through 30 September 2012, a period during which the applicant was board certified by the American Board of Radiology, but was not authorized payment.
   
   b.  Requests for BCP are initiated by the officer through their supporting Human Resources office.  A review of supporting documentation and available special pay and finance data indicates the applicant's BCP was started on 1 October 2012, with a current expiration annotated as 1 July 2022.  There is no record of authorization or payment for BCP for the 3-month period from 1 July 2012 through 30 September 2012.
   
   c.  The applicant is eligible to receive BCP for the 3-month period from 1 July 2012 through 30 September 2012.  Utilize a Health Professions Pay Entry Date or Finance Medical Services-Pay-Date of 6 June 2007 for the correct pay rate level.  The retroactive payment for this total period is approximately $625.00 prior to taxes, exact payment to be determined by the Defense Finance and Accounting Service-Indianapolis (DFAS-IN).  
   
5.  On 15 May 2013, the opinion was forwarded to the applicant for acknowledgement and possible rebuttal and he concurred on 30 May 2013.

DISCUSSION AND CONCLUSIONS:

1.  The evidence of record shows the applicant was fully eligible for entitlement to BCP for the period from 1 July 2012 through 30 September 2012, but did not receive BCP for this period.

2.  Based on a review of the applicant's certification documentation and military pay account, it was determined that the applicant's BCP was started as of 1 October 2012 with an expiration of 1 July 2022.  The AMEDD Special Pay Branch could not initiate BCP to cover this period because the period of arrears exceeded their authority as granted by DFAS for payment. 

3.  In view of the facts in this case, he is entitled to payment of BCP in arrears for the period 1 July 2012 through 30 September 2012, utilizing a Health Professions Pay Entry Date or Finance Medical Services-Pay-Date of 6 June 2007, for the correct pay rate level.

4.  Therefore, his records should be corrected as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing the applicant was approved for Board Certification Pay and paying him Board Certification Pay in arrears for the period 1 July 2012 through 30 September 2012, utilizing a Health Professions Pay Entry Date or Finance Medical Services-Pay-Date of 6 June 2007, for the correct pay rate level.
