THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests Board Certification Pay (BCP) for the period 
1 February 2012 to 28 February 2013.

2.  The applicant states he would like to initiate a petition to get back his BCP for the 13-month period stated above.  He never had a break in board certification.  However, his BCP stopped on 20120131. He had it restarted and he received back pay commencing on 1 March 2013.

3.  The applicant provides copies of:

* Letter from the American Board of Preventive Medicine (ABPM), Inc., dated 18 November 2011
* Letter from the ABPM, Inc, dated 28 January 2002

CONSIDERATION OF EVIDENCE:

1.  The applicant is currently serving on active duty in the rank of lieutenant colonel assigned to the U.S. Army Public Health Command in Bethesda, Maryland, in preventive medicine.

2.  He provides documentation that shows he is board certified by the American Board of Preventive Medicine.  The period of certification is from 2002 through 2022.

3.  In the processing of this case, an advisory opinion was obtained from the Chief, Army Medical Department Special Pay Branch, Office of The Surgeon General.  The advisory official recommends payment of BCP for the 13 month period 1 February 2012 to 28 February 2013.  The advisory official states:

	a.  a review of supporting documentation and available special pay and finance data indicates the applicant's BCP was paid through 31 January 2012,  restarted on 1 March 2013, with current expiration on 31 January 2022.  

	b.  there is no record of submission, authorization, or payment of BCP for the missing period of 1 February 2012 to 28 February 2013.

	c.  the applicant is eligible to receive BCP for the period 1 February 2012 through 28 February 2013.

	d.  utilize a Health Professions Pay Entry Date or finance MS-Pay-Date of 
16 May 1998 for the correct pay rate level.  The retroactive payment for this total period is approximately $5,125.00 prior to withholding.  Exact payment to be determined by the Defense Finance and Accounting Service (DFAS).

4.  The advisory opinion was furnished to the applicant for information and to allow him the opportunity to submit comments or a rebuttal.  No response was received.

5.  Title 37, U.S. Code, sections 301d, 302, 302f, and 303a, provides for multi-year retention bonuses and special pays for medical officers and health professionals of the Armed Forces.  For Army Medical Corps officers (physicians), these special pays include BCP which is paid monthly to all board-certified Medical Corps officers based upon their date of board certification and their creditable service used to establish the Health Professional Pay Entry Date.

DISCUSSION AND CONCLUSIONS:

1.  Evidence shows the applicant received board certification by the American Board of Pediatrics in 2002.

2.  The advisory opinion points out:
* his BCP was paid through 31 January 2012, restarted on 
      1 March 2013, with a current expiration of 31 January 2022
* there is no record of authorization or payment of BCP for the period
1 February 2012 to 28 February 2013
* he is eligible to receive BCP for the period 1 February 2012 to                 28 February 2013

3.  In view of the foregoing the applicant's request should be granted.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  showing the applicant was approved for Board Certification Pay;  and 

	b.  paying him Board Certification Pay in arrears for the period 1 February 2012 through 28 February 2013, utilizing a Health Professions Pay Entry Date or finance MS-Pay-Date of 16 May 1998 for the correct pay rate level.
