THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that she be granted retroactive Board Certification Pay (BCP) from 28 August 2008 through 30 June 2009.
2. The applicant states she took the Internal Medicine Board Exam on 28 August 2008 and after finding out that she qualified for additional pay, she applied in July 2009. By August 2009 the local medical command had put together a DA Form 4187 (Request for Personnel Action) but despite numerous inquiries she was unable to get the pay until she relocated in June 2010. She was informed that she could only receive 12 months of back pay and would have to apply to this Board in order to receive the remainder.
3. The applicant provides an American Board of Internal Medicine Verification of Physician Certification, a DA Form 4187, and an email message in which she inquired about BCP.
CONSIDERATION OF EVIDENCE:
1. The applicant was appointed a Reserve commissioned officer on 31 May 2001. She was ordered to active duty effective 9 June 2005.
2. In connection with the processing of this case, an advisory opinion was obtained from the Chief, Army Medical Department (AMEDD) Special Pay Branch. The opinion states the applicant indicated in her petition that she is requesting BCP retroactive from 28 August 2008 through 30 June 2009, a period in which she was board certified but the BCP was not authorized for payment.
3. The opinion also states that a review of her available finance data indicates she received BCP effective 1 July 2009, with a current expiration of 31 December 2018. She did not receive BCP for the period 28 August 2008 through 30 June 2009 and their office cannot initiate BCP for this period because the period of arrears exceeds their authority as granted by the Defense Finance and Accounting (DFAS) Indianapolis Center. The opinion further states that she was eligible to receive BCP for the period 28 August 2008 through 30 June 2009 utilizing a Health Professions Pay Entry Date or finance Medical Services-Pay-Date of 9 June 2005, for the correct pay rate level.
4. The advisory opinion was forwarded to the applicant for comments and/or rebuttal. She responded in agreement with the advisory opinion.
5. She provided a Verification of Physician Certification that confirms she was board certified effective 28 August 2008 with a certificate valid through
31 December 2018.
DISCUSSION AND CONCLUSIONS:
1. The evidence shows the applicant was eligible for payment of BCP in arrears for the period 28 August 2008 through 30 June 2009 but did not receive BCP for this period. The AMEDD Special Pay Branch could not initiate BCP to cover this because the period of arrears exceeded their authority as granted by DFAS.
2. Based on the foregoing, she is entitled to payment of BCP in arrears for the period 28 August 2008 through 30 June 2009 utilizing a Health Professions Pay Entry Date or finance Medical Services-Pay-Date of 9 June 2005, for the correct pay rate level.
